HOUSE CONCURRENT RESOLUTION
1-1 WHEREAS, H.B. 710 has been adopted by the house of
1-2 representatives and the senate; and
1-3 WHEREAS, The bill contains technical and typographical errors
1-4 that need correction; now, therefore, be it
1-5 RESOLVED, That the enrolling clerk of the house of
1-6 representatives be hereby instructed to make the following
1-7 corrections:
1-8 (1) In Section 1.01 of the bill, in Section 2(11),
1-9 Article 3.77, Insurance Code, as added by the bill, strike "For the
1-10 purposes of this Act, insurer includes" and substitute "For the
1-11 purposes of this article, "insurer" includes".
1-12 (2) In Section 1.01 of the bill, in Section 2(13),
1-13 Article 3.77, Insurance Code, as added by the bill, strike "Title
1-14 XVII, Social Security Act (42 U.S.C. Section 1395 et seq.)" and
1-15 substitute "Title XVIII, Social Security Act (42 U.S.C. Section
1-16 1395c et seq.)".
1-17 (3) In Section 1.02 of the bill, in Section 4(g),
1-18 Article 3.77, Insurance Code, as amended by the bill, strike
1-19 "designate one of its appointees" and substitute "designate one of
1-20 the commissioner's [its] appointees".
1-21 (4) In Section 1.04 of the bill, in Section 6(b)(4),
1-22 Article 3.77, Insurance Code, as amended by the bill, strike
1-23 "provided by or through the pool to recover any amounts erroneously
1-24 or improperly paid by the pool" and substitute "provided by or
2-1 through the pool, to recover any amounts erroneously or improperly
2-2 paid by the pool".
2-3 (5) In Section 1.08 of the bill, in Section 10(a)(4),
2-4 Article 3.77, Insurance Code, as added by the bill, strike "the
2-5 individual has maintained health insurance" and substitute "the
2-6 individual's maintenance of health insurance".
2-7 (6) In Section 1.08 of the bill, in Section 10(d)(5),
2-8 Article 3.77, Insurance Code, as added by the bill, strike "the
2-9 person's premiums are paid for" and substitute "has premiums that
2-10 are paid for".
2-11 (7) In Section 1.08 of the bill, in Section 10(d)(6),
2-12 Article 3.77, Insurance Code, as added by the bill, strike "the
2-13 person".
2-14 (8) In Section 2.01 of the bill, in Section
2-15 1(d)(3)(A)(v), Article 3.51-6, Insurance Code, as added by the
2-16 bill, strike "or one of the conditions specified in items (aa)
2-17 through (dd) of Subparagraph (ii), Paragraph (A) above is met by
2-18 the covered individual;".
2-19 (9) In Section 2.01 of the bill, in Section
2-20 1(d)(3)(A)(v), Article 3.51-6, Insurance Code, as added by the
2-21 bill, at the end of that subparagraph, strike the underlined period
2-22 and substitute "[or one of the conditions specified in items (aa)
2-23 through (dd) of Subparagraph (ii), Paragraph (A) above is met by
2-24 the covered individual]."
2-25 (10) In Section 2.01 of the bill, in Section
2-26 1(d)(3)(B)(i), Article 3.51-6, Insurance Code, as added by the
2-27 bill, strike "Such converted policy shall be issued without
3-1 evidence of insurability if written application for and payment of
3-2 the first premium is made not later than the 31st day after the
3-3 date of termination. The converted policy" and substitute "Such a
3-4 conversion policy shall be issued without evidence of insurability
3-5 if a written application for the policy and payment of the first
3-6 premium are made not later than the 31st day after the date of
3-7 termination. The conversion policy".
3-8 (11) In Section 2.01 of the bill, in Section
3-9 1(d)(3)(B)(ii), Article 3.51-6, Insurance Code, as added by the
3-10 bill, strike "Subparagraph (v), Paragraph (3)(A) above" and
3-11 substitute "Subparagraph (v), Paragraph (A), of this subdivision".
3-12 (12) In Section 2.01 of the bill, in Section
3-13 1(d)(3)(B)(ii), Article 3.51-6, Insurance Code, as added by the
3-14 bill, strike "under policies issued pursuant to this subsection."
3-15 and substitute "under policies issued pursuant to this paragraph."
3-16 (13) In Section 3.01 of the bill, in Section
3-17 1(H)(4)(b), Chapter 397, Acts of the 54th Legislature, Regular
3-18 Session, 1955 (Article 3.70-1, Vernon's Texas Insurance Code), as
3-19 added by the bill, strike "coverage under a self-funded or
3-20 self-insured employee welfare benefit plan" and substitute "a
3-21 self-funded or self-insured employee welfare benefit plan".
3-22 (14) In Section 3.01 of the bill, in Section
3-23 1(H)(4)(b), Chapter 397, Acts of the 54th Legislature, Regular
3-24 Session, 1955 (Article 3.70-1, Vernon's Texas Insurance Code), as
3-25 added by the bill, strike "coverage under any group or individual
3-26 health benefit plan" and substitute "any group or individual health
3-27 benefit plan".
4-1 (15) In Section 3.02 of the bill, in Subsection
4-2 (b)(4), Article 3.70-1A, Insurance Code, as added by the bill,
4-3 strike "under this paragraph" and substitute "under this
4-4 subdivision".
4-5 (16) In Section 4.01 of the bill, in Section
4-6 9(k)(A)(5), Texas Health Maintenance Organization Act (Article
4-7 20A.09, Vernon's Texas Insurance Code), as added by the bill,
4-8 strike "as provided under Article 3.77 of this code" and substitute
4-9 "as provided under Article 3.77, Insurance Code".
4-10 (17) In Section 4.01 of the bill, in the last sentence
4-11 of Section 9(k)(B), Texas Health Maintenance Organization Act
4-12 (Article 20A.09, Vernon's Texas Insurance Code), as added by the
4-13 bill, strike "contracts issued pursuant to this subsection" and
4-14 substitute "contracts issued pursuant to this subdivision".
4-15 (18) In Section 4.01 of the bill, in the last sentence
4-16 of Section 9(k)(C), Texas Health Maintenance Organization Act
4-17 (Article 20A.09, Vernon's Texas Insurance Code), as added by the
4-18 bill, strike "the premium determined in accordance with this
4-19 paragraph" and substitute "the premium determined in accordance
4-20 with this subdivision".
4-21 (19) In Section 4.01 of the bill, in Section 9(l)(D),
4-22 Texas Health Maintenance Organization Act (Article 20A.09, Vernon's
4-23 Texas Insurance Code), as added by the bill, strike "necessary to
4-24 implement this article" and substitute "necessary to implement this
4-25 subsection".
