                             HOUSE CONCURRENT RESOLUTION

 1-1           WHEREAS, Mark Buchine alleges that:

 1-2                 (1)  in 1994, the Office of Training and Development at

 1-3     The  University of Texas Medical Branch at Galveston (UTMB)

 1-4     requested leadership training materials and seminars from Covey

 1-5     Leadership Center of Houston, Inc., which is owned by Mark Buchine;

 1-6                 (2)  Mr. Buchine shipped the training materials and

 1-7     goods and provided seminars and other services for UTMB during the

 1-8     months of February through December 1994;

 1-9                 (3)  Mr. Buchine sent a total of 20 invoices requesting

1-10     payment for the goods and services provided;

1-11                 (4)  UTMB has refused to make payment for the goods and

1-12     services that are due under the contract provided by Mr. Buchine's

1-13     company; and

1-14                 (5)  Mr. Buchine is entitled to the balance due of

1-15     $76,153.30, plus attorney's fees and any other relief to which his

1-16     company is entitled; now, therefore, be it

1-17           RESOLVED by the Legislature of the State of Texas, That Mark

1-18     Buchine is granted permission to sue the State of Texas and The

1-19     University of Texas Medical Branch at Galveston subject to Chapter

1-20     107, Civil Practice and Remedies Code; and, be it further

1-21           RESOLVED, That the chairman of the Board of Regents of The

1-22     University of Texas System be served process as provided by Section

1-23     107.002(a)(3), Civil Practice and Remedies Code.
