No. 34 75R2776 CAG-D A JOINT RESOLUTION 1-1 proposing a constitutional amendment to dedicate net revenue from 1-2 the state lottery to public school purposes. 1-3 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 47, Article III, Texas Constitution, is 1-5 amended by amending Subsection (e) and by adding Subsection (f) to 1-6 read as follows: 1-7 (e) The Legislature by general law may authorize the State 1-8 to operate lotteries and may authorize the State to enter into a 1-9 contract with one or more legal entities that will operate 1-10 lotteries on behalf of the State. The Legislature shall fund the 1-11 system of public free schools with money from the general revenue 1-12 fund and any other appropriate constitutionally or statutorily 1-13 created fund or account. All money received by the State from the 1-14 operation of lotteries, other than amounts paid for lottery prizes 1-15 and administrative costs, shall be deposited in the state treasury 1-16 and is dedicated to and may be expended only for the enrichment of 1-17 the educational programs of the public primary and secondary 1-18 schools and only for items that directly benefit classroom 1-19 teaching, including teacher compensation and the acquisition of 1-20 textbooks and other educational supplies, materials, equipment, and 1-21 services. The amount of money dedicated by this subsection and 1-22 appropriated each fiscal biennium shall result in an equal 1-23 reduction in general revenue funds that would otherwise have been 1-24 allocated for public school purposes. 2-1 (f) An advertisement or promotion sponsored by the State or 2-2 a holder of a license issued by the State related to the operation 2-3 of a lottery authorized by Subsection (e) of this section may not 2-4 encourage or attempt to influence a person to purchase a lottery 2-5 ticket or number for the purpose of supporting or providing more 2-6 funds to public primary or secondary schools. 2-7 SECTION 2. This proposed constitutional amendment shall be 2-8 submitted to the voters at an election to be held November 4, 1997. 2-9 The ballot shall be printed to permit voting for or against the 2-10 following proposition: "The constitutional amendment to dedicate 2-11 net revenue from the state lottery to offset the costs of public 2-12 school educational programs."
