No. 86 75R5808 DRH-D A JOINT RESOLUTION 1-1 proposing a constitutional amendment to limit the time that a 1-2 member of the Bexar County Commissioners Court may serve in office. 1-3 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Article V of the Texas Constitution is amended by 1-5 adding Section 32 to read as follows: 1-6 Sec. 32. (a) This section applies only in Bexar County to 1-7 an office on the commissioners court of the county, including the 1-8 office of the county judge established under Section 15 of this 1-9 article. 1-10 (b) A person is not eligible to serve a full or partial term 1-11 in an office described by Subsection (a) of this section if on 1-12 December 31 of the last full calendar year of the term the person 1-13 will have held office on the commissioners court during any part of 1-14 each of 12 or more calendar years. 1-15 (c) Nothing in this section prohibits a person from 1-16 continuing to serve in an office covered by this section after the 1-17 end of a term as a holdover under Section 17, Article XVI, of this 1-18 constitution, or other law until a successor is qualified. 1-19 (d) For purposes of this section, a calendar year begins 1-20 January 1 and ends December 31. 1-21 (e) Service as a county commissioner and service as a county 1-22 judge in Bexar County are counted for purposes of determining 1-23 whether a person is disqualified from serving under this section in 1-24 an office on the commissioners court. 2-1 (f) Service in office during a term that begins before 2-2 January 1, 1999, does not count for purposes of determining whether 2-3 a person is disqualified from office under this section. 2-4 SECTION 2. This proposed constitutional amendment shall be 2-5 submitted to the voters at an election to be held November 4, 1997. 2-6 The ballot shall be printed to permit voting for or against the 2-7 following proposition: "The constitutional amendment to limit the 2-8 time that a member of the Bexar County Commissioners Court may 2-9 serve in office."
