                                 A JOINT RESOLUTION

 1-1     proposing a constitutional amendment to prohibit the state or a

 1-2     political subdivision of the state from imposing a tax.

 1-3           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Article III, Texas Constitution, is amended by

 1-5     adding Section 42 to read as follows:

 1-6           Sec. 42.  PROHIBITION OF TAXATION.  Notwithstanding any other

 1-7     provision of this constitution, neither this state nor a political

 1-8     subdivision of this state may impose a tax.

 1-9           SECTION 2.  The following temporary provision is added to the

1-10     Texas Constitution:

1-11           TEMPORARY PROVISION.  (a)  This temporary provision applies

1-12     to the constitutional amendment proposed by _____ J.R. No. _____,

1-13     75th Legislature, Regular Session, 1997, and expires January 2,

1-14     2000.

1-15           (b)  Section 42, Article III, of this constitution takes

1-16     effect January 1, 2000.

1-17           SECTION 3.  Effective January 1, 2000, Article VIII, Texas

1-18     Constitution, is repealed.

1-19           SECTION 4.  This proposed constitutional amendment shall be

1-20     submitted to the voters at an election to be held November 4, 1997.

1-21     The ballot shall be printed to permit voting for or against the

1-22     proposition: "The constitutional amendment to prohibit the state or

1-23     a political subdivision of the state from imposing a tax."
