                                 A JOINT RESOLUTION

1-1 proposing a constitutional amendment allowing a county to hold an

1-2 election to abolish the office of county treasurer.

1-3 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-4 SECTION 1. Section 44, Article 16, Texas Constitution, is

1-5 amended by adding Subsection (j) to read as follows:

1-6 (j) The Commissioners Court of a county may call an election

1-7 to abolish the office of County Treasurer in the county. The

1-8 office of County Treasurer in the county is abolished if a majority

1-9 of the voters of the county voting on the question at that election

1-10 approve the abolition. If an election is called under this

1-11 subsection, the Commissioners Court shall order the ballot for the

1-12 election to be printed to permit voting for or against the

1-13 proposition: "Abolishing the office of county treasurer of this

1-14 county." If the office of County Treasurer is abolished, the

1-15 functions of the office are transferred to a county officer

1-16 designated by the Commissioners Court of the county in which the

1-17 office is abolished on the first day of the calendar year that

1-18 follows the election, and the Commissioners Court may from time to

1-19 time change its designation as it considers appropriate.

1-20 SECTION 2. This proposed constitutional amendment shall be

1-21 submitted to the voters at an election to be held on November 4,

1-22 1997. The ballot shall be printed to permit voting for or against

1-23 the proposition: "The constitutional amendment allowing a county

1-24 to hold an election to abolish the office of county treasurer."
