                                 R E S O L U T I O N

 1-1           WHEREAS, Chapter 706, Acts of the 73rd Legislature, Regular

 1-2     Session, 1993, enacted psychiatric hospital reforms directed

 1-3     against providers who were transporting fraudulently referred

 1-4     clients to their facilities (Section 161.091, Health and Safety

 1-5     Code); and

 1-6           WHEREAS, This prohibition was not intended to apply to

 1-7     nonpsychiatric hospitals that provide free transportation as a

 1-8     community service; and

 1-9           WHEREAS, Currently, this provision could be construed to

1-10     prohibit benign activity such as transporting low-income elderly

1-11     individuals for free blood pressure screening or other

1-12     health-related community education services; now, therefore, be it

1-13           RESOLVED, That the House of Representatives of the 75th Texas

1-14     Legislature hereby establish that the intent of this chamber when

1-15     enacting and amending Section 161.091, Health and Safety Code, was

1-16     not to prohibit a person from providing transportation for health

1-17     care services to adult patients as a community service if the

1-18     transportation service is valued at not more than $20 per one-way

1-19     trip, is not provided by a mental health provider, and does not

1-20     involve transportation to a mental health facility; and, be it

1-21     further

1-22           RESOLVED, That the health care services envisioned as

1-23     permitted under this provision include services routinely provided

1-24     in a hospital-based outpatient clinic and health-related community

 2-1     education services; and, be it further

 2-2           RESOLVED, That an official copy of this resolution be

 2-3     forwarded to the commissioner of health in the Texas Department of

 2-4     Health.
