R E S O L U T I O N 1-1 BE IT RESOLVED by the House of the State of Texas, 75th 1-2 Legislature, Regular Session, 1997, That House Rule 13, Section 1-3 9(a), be suspended in part as provided by House Rule 13, Section 1-4 9(f), to enable the conference committee appointed to resolve the 1-5 differences on House Bill No. 318 to consider and take action on 1-6 the following specific matter: 1-7 House Rule 13, Section 9(a)(4), is suspended to permit the 1-8 committee to add Section 12.1011, Education Code, to read as 1-9 follows: 1-10 Sec. 12.1011. PUBLIC EDUCATION GRANT CHARTERS. (a) In 1-11 addition to the other charters authorized under this subchapter, in 1-12 accordance with this subchapter the State Board of Education may 1-13 grant: 1-14 (1) not more than 100 charters for open-enrollment 1-15 charter schools that adopt an express policy providing for the 1-16 admission of students eligible for a public education grant under 1-17 Subchapter G, Chapter 29; and 1-18 (2) additional charters for open-enrollment charter 1-19 schools for which at least 75 percent of the prospective student 1-20 population, as specified in the proposed charter, will be students 1-21 who have dropped out of school or are at risk of dropping out of 1-22 school as defined by Section 29.081. 1-23 (b) An open-enrollment charter school granted a charter 1-24 under this section may serve students who are not eligible for a 2-1 public education grant under Subchapter G, Chapter 29, but a school 2-2 granted a charter under Subsection (a)(2) must maintain, as a 2-3 condition of its charter, the required percentage of students. 2-4 Explanation: This change is necessary to permit the 2-5 committee to permit the State Board of Education to authorize 2-6 additional open-enrollment charter schools to serve students who 2-7 are eligible for public education grants, who have dropped out of 2-8 school, or are at risk of dropping out of school.
