                                 R E S O L U T I O N

 1-1           BE IT RESOLVED by the House of Representatives of the State

 1-2     of Texas, 75th Legislature, Regular Session, 1997, That House Rule

 1-3     13, Section 9(a), be suspended in part as provided by House Rule

 1-4     13, Section 9(f), to enable the conference committee appointed to

 1-5     resolve the differences on S.B. No. 360 to consider and take action

 1-6     on the following matters:

 1-7           1.  House Rule 13, Section 9(a)(4), is suspended to permit

 1-8     the committee to add new Sections 4.03 and 4.04 to the bill to read

 1-9     as follows:

1-10           SECTION 4.03.  Section 411.002(c), Government Code, is

1-11     amended to read as follows:

1-12           (c)  The Department of Public Safety of the State of Texas is

1-13     subject to Chapter 325 (Texas Sunset Act).  Unless continued in

1-14     existence as provided by that chapter, the department is abolished

1-15     and Subsections (a) and (b) expire September 1, 1999 [2005].

1-16           SECTION 4.04.  The Department of Public Safety shall pay the

1-17     costs incurred by the Sunset Advisory Commission in performing the

1-18     review of the department under Section 411.002(c), Government Code,

1-19     as amended by this Act.  The Sunset Advisory Commission shall

1-20     determine the amount of the costs, and the department shall pay the

1-21     amount promptly on receipt of a statement from the commission

1-22     showing the costs.

1-23           Explanation:  This change is necessary to provide for an

1-24     earlier sunset review of the Department of Public Safety and

 2-1     provide for the payment of the cost of that review.

 2-2           2.  House Rule 13, Section 9(a)(4), is suspended to permit

 2-3     the committee to add new Sections 4.08 and 4.09 to the bill and to

 2-4     add Subsections (d) and (e) to Section 6.01 of the bill to read as

 2-5     follows:

 2-6           (a)  Sections 4.08 and 4.09 are added to read as follows:

 2-7           SECTION 4.08.  Section 201.204, Transportation Code, is

 2-8     amended to read as follows:

 2-9           Sec. 201.204.  SUNSET PROVISION.  The Texas Department of

2-10     Transportation is subject to Chapter 325, Government Code (Texas

2-11     Sunset Act).  Unless continued in existence as provided by that

2-12     chapter, the department is abolished September 1, 1999 [1997].

2-13           SECTION 4.09.  Section 361.003, Transportation Code, is

2-14     amended to read as follows:

2-15           Sec. 361.003.  SUNSET PROVISION.  The Texas Turnpike

2-16     Authority is subject to Chapter 325, Government Code (Texas Sunset

2-17     Act).  Unless continued in existence as provided by that chapter,

2-18     the authority is abolished and this chapter expires September 1,

2-19     1999 [1997].

2-20           (b)  Subsections (d) and (e) are added to Section 6.01 to

2-21     read as follows:

2-22           (d)  The section of this Act that amends Section 201.204,

2-23     Transportation Code, takes effect only if the 75th Legislature,

2-24     Regular Session, 1997, does not enact other legislation that

2-25     becomes law and that amends Section 201.204, Government Code, to

2-26     extend the sunset date of the Texas Department of Transportation.

2-27           (e)  The section of this Act that amends Section 361.003,

 3-1     Transportation Code, takes effect only if the 75th Legislature,

 3-2     Regular Session, 1997, does not enact other legislation that

 3-3     becomes law and that amends Section 361.003, Government Code, to

 3-4     extend the sunset date of the Texas Turnpike Authority.

 3-5           Explanation:  This change is necessary to provide for the

 3-6     continuation of the Texas Department of Transportation and the

 3-7     Texas Turnpike Authority if the 75th Legislature, Regular Session,

 3-8     1997, does not enact other legislation that becomes law that would

 3-9     continue those agencies.
