1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to the regulation of the use of bingo card-minding devices
1-11 and to certain persons authorized to use such devices.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subsection (v), Section 11, Bingo Enabling Act
1-14 (Article 179d, Vernon's Texas Civil Statutes), is amended to read
1-15 as follows:
1-16 (v) A person may not use a card-minding device:
1-17 (1) to generate or determine the random letters,
1-18 numbers, or other symbols used in playing the bingo card played
1-19 with the device's assistance;
1-20 (2) as a receptacle for the deposit of tokens or
1-21 money, including coins or paper currency, in payment for playing
1-22 the bingo card played with the device's assistance; or
1-23 (3) except as provided by Section 13e(i) of this Act,
1-24 as a dispenser for the payment of a bingo prize, including coins,
1-25 paper currency, or any thing of value for the bingo card played
1-26 with the device's assistance. No more than 40 [30] percent of the
1-27 individuals attending a [gross bingo game sales at each] bingo
1-28 occasion, based on the average of the two quarterly attendance
1-29 reports that have been most recently submitted to the commission by
1-30 the authorized organization, may use [can be on] electronic or
1-31 mechanical card-minding devices. This provision does not
1-32 include[,] pull-tabs, instant bingo tickets, or break-open bingo
1-33 games.
1-34 SECTION 2. Section 13e, Bingo Enabling Act (Article 179d,
1-35 Vernon's Texas Civil Statutes), is amended by adding Subsections
1-36 (i) through (l) to read as follows:
1-37 (i) Section 11(v)(3) of this Act does not apply to a system
1-38 service provider.
1-39 (j) A system service provider may use bar codes on bingo
1-40 paper as a means of providing accurate tracking, registering, and
1-41 accounting records.
1-42 (k) A system service provider may purchase goods or services
1-43 from a licensed manufacturer.
1-44 (l) The commission shall include a system service provider
1-45 as a member of a bingo advisory committee appointed under Section
1-46 43 of this Act.
1-47 SECTION 3. This Act takes effect October 1, 1997.
1-48 SECTION 4. The importance of this legislation and the
1-49 crowded condition of the calendars in both houses create an
1-50 emergency and an imperative public necessity that the
1-51 constitutional rule requiring bills to be read on three several
1-52 days in each house be suspended, and this rule is hereby suspended.
