                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the boundaries, confirmation election, and taxing

 1-2     authority of the Clear Creek Watershed Regional Flood Control

 1-3     District.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 3, Chapter 699, Acts of the 74th

 1-6     Legislature, 1995, is amended to read as follows:

 1-7           Sec. 3.  BOUNDARIES OF DISTRICT.  The district is composed of

 1-8     land in Harris County, Galveston County, Brazoria County, and Fort

 1-9     Bend County.  The boundaries of the district can be described as

1-10     follows:

1-11     Being approximately 186.4-square miles of land in Harris County,

1-12     Galveston County, Brazoria County and Fort Bend County, Texas; and

1-13     being out of and a portion of the unincorporated areas of said

1-14     counties lying within the following described 186.4-square miles of

16-14    that part of Harris County tract 0370.10 included in block groups 1

16-15    and 2 and blocks 301A, 301B, and 303; and that part of Harris

16-16    County tract 0373.02 included in block group 6 and blocks 305, 308,

16-17    309, 702, 703, 704, and 705; and that part of Harris County tract

16-18    0373.03 included in block groups 1, 2, 3, and blocks 401A, 401B,

16-19    403, 409, 410, 411, 412, 413, 414, 415, 416, 417, 418, 419, 420,

16-20    421, 422, 423, 505, 506, 507, 508, 509, 510, 511, and 512; and that

16-21    part of Harris County tract 0373.11 included in blocks 101A, 101B,

16-22    102, 103, 104, 301A, 301B, 302, 303A, and 303B; and that part of

16-23    Harris County tract 0373.21 included in block groups 2 and 3 and

16-24    blocks 111, and 112].

16-25          SECTION 2.  Subsection (a), Section 5, Chapter 699, Acts of

 17-1    the 74th Legislature, 1995, is amended to read as follows:

 17-2          (a)  The district may not exercise a power granted by this

 17-3    Act other than a power granted by this section until the creation

 17-4    of the district is confirmed by a majority of the resident electors

 17-5    of the district voting at a confirmation election called under this

 17-6    section.  The initial board shall call a confirmation election to

 17-7    be held not later than three [two] years after the effective date

 17-8    of this Act within the boundaries of the proposed district.  The

 17-9    board may call subsequent confirmation elections if the district is

17-10    not confirmed at the first election.  Expenses of a confirmation

17-11    election shall be paid in equal shares by each of the commissioners

17-12    courts and shall be repaid by the district if creation of the

17-13    district is confirmed.  Section 41.001(a), Election Code, does not

17-14    apply to a confirmation election.

17-15          SECTION 3.  Subsections (a) and (b), Section 37, Chapter 699,

17-16    Acts of the 74th Legislature, 1995, are amended to read as follows:

17-17          (a)  An ad valorem maintenance tax under Subsection (b) must

17-18    be authorized by a majority vote of the voters qualified to vote

17-19    and voting in the district at an election called and held for that

17-20    purpose.

17-21          (b)  If approved by the voters, the [The] district may levy,

17-22    assess, and collect an annual ad valorem tax on all taxable

17-23    property in the district for the maintenance, operation, upkeep,

17-24    and improvement of the district and its facilities, properties, and

17-25    improvements.

 18-1          [(b)  An ad valorem maintenance tax under Subsection (a) must

 18-2    be authorized by a majority vote of the voters qualified to vote

 18-3    and voting in the district at an election called and held for that

 18-4    purpose.]

 18-5          SECTION 4.  The importance of this legislation and the

 18-6    crowded condition of the calendars in both houses create an

 18-7    emergency and an imperative public necessity that the

 18-8    constitutional rule requiring bills to be read on three several

 18-9    days in each house be suspended, and this rule is hereby suspended,

18-10    and that this Act take effect and be in force from and after its

18-11    passage, and it is so enacted.
