 1-8     relating to the boundaries, confirmation election, and taxing

 1-9     authority of the Clear Creek Watershed Regional Flood Control

1-10     District.

1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-12           SECTION 1.  Section 3, Chapter 699, Acts of the 74th

1-13     Legislature, 1995, is amended to read as follows:

1-14           Sec. 3.  BOUNDARIES OF DISTRICT.  The district is composed of

1-15     land in Harris County, Galveston County, Brazoria County, and Fort

1-16     Bend County.  The boundaries of the district can be described as

1-17     follows:

1-18     Being approximately 186.4-square miles of land in Harris County,

1-19     Galveston County, Brazoria County and Fort Bend County, Texas; and

6-62     102, 103, 104, 301A, 301B, 302, 303A, and 303B; and that part of

6-63     Harris County tract 0373.21 included in block groups 2 and 3 and

6-64     blocks 111, and 112].

6-65           SECTION 2.  Subsection (a), Section 5, Chapter 699, Acts of

6-66     the 74th Legislature, 1995, is amended to read as follows:

6-67           (a)  The district may not exercise a power granted by this

6-68     Act other than a power granted by this section until the creation

6-69     of the district is confirmed by a majority of the resident electors

 7-1     of the district voting at a confirmation election called under this

 7-2     section.  The initial board shall call a confirmation election to

 7-3     be held not later than three [two] years after the effective date

 7-4     of this Act within the boundaries of the proposed district.  The

 7-5     board may call subsequent confirmation elections if the district is

 7-6     not confirmed at the first election.  Expenses of a confirmation

 7-7     election shall be paid in equal shares by each of the commissioners

 7-8     courts and shall be repaid by the district if creation of the

 7-9     district is confirmed.  Section 41.001(a), Election Code, does not

7-10     apply to a confirmation election.

7-11           SECTION 3.  Subsections (a) and (b), Section 37, Chapter 699,

7-12     Acts of the 74th Legislature, 1995, are amended to read as follows:

7-13           (a)  An ad valorem maintenance tax under Subsection (b) must

7-14     be authorized by a majority vote of the voters qualified to vote

7-15     and voting in the district at an election called and held for that

7-16     purpose.

7-17           (b)  If approved by the voters, the [The] district may levy,

7-18     assess, and collect an annual ad valorem tax on all taxable

7-19     property in the district for the maintenance, operation, upkeep,

7-20     and improvement of the district and its facilities, properties, and

7-21     improvements.

7-22           [(b)  An ad valorem maintenance tax under Subsection (a) must

7-23     be authorized by a majority vote of the voters qualified to vote

7-24     and voting in the district at an election called and held for that

7-25     purpose.]

7-26           SECTION 4.  The importance of this legislation and the

7-27     crowded condition of the calendars in both houses create an

7-28     emergency and an imperative public necessity that the

7-29     constitutional rule requiring bills to be read on three several

7-30     days in each house be suspended, and this rule is hereby suspended,

7-31     and that this Act take effect and be in force from and after its

7-32     passage, and it is so enacted.
