                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to certain previously waived service credit in the

 1-2     Employees Retirement System of Texas.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter E, Chapter 813, Government Code, is

 1-5     amended by adding Section 813.406 to read as follows:

 1-6           Sec. 813.406.  CERTAIN PREVIOUSLY WAIVED SERVICE.  (a)  A

 1-7     person who served in the legislature before 1964, who before

 1-8     leaving state office did not elect to become a member of the

 1-9     retirement system at the time membership was extended to elected

1-10     officers in 1963, and who subsequently served as a member of the

1-11     United States Congress for at least 30 years may, before September

1-12     1, 1998, establish service credit in the retirement system for the

1-13     person's state legislative service.

1-14           (b)  A person may establish credit under this section by

1-15     depositing with the retirement system in a lump sum a contribution

1-16     computed as provided by Section 813.404, plus all membership fees

1-17     due, plus interest computed at an annual rate of 10 percent from

1-18     the fiscal year in which the service was performed to the date of

1-19     deposit.

1-20           (c)  This section expires September 1, 1998.

1-21           SECTION 2.  This Act takes effect September 1, 1997.

1-22           SECTION 3.  The importance of this legislation and the

1-23     crowded condition of the calendars in both houses create an

 2-1     emergency and an imperative public necessity that the

 2-2     constitutional rule requiring bills to be read on three several

 2-3     days in each house be suspended, and this rule is hereby suspended.
