                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to testing persons for reportable diseases.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 81.050(b), Health and Safety Code, is

 1-5     amended to read as follows:

 1-6           (b)  A person whose occupation or whose volunteer service is

 1-7     included in one or more of the following categories may request the

 1-8     department or a health authority to order testing of another person

 1-9     who may have exposed the person to a reportable disease, including

1-10     HIV infection:

1-11                 (1)  a law enforcement officer;

1-12                 (2)  a fire fighter;

1-13                 (3)  an emergency medical service employee or

1-14     paramedic; [or]

1-15                 (4)  a correctional officer; or

1-16                 (5)  a person, except a health care worker, who

1-17     administers emergency care at the scene of an emergency.

1-18           SECTION 2.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

1-22     days in each house be suspended, and this rule is hereby suspended,

1-23     and that this Act take effect and be in force from and after its

1-24     passage, and it is so enacted.
