AN ACT

 1-1     relating to the review and continuation of certain state agencies

 1-2     and laws subject to the Texas Sunset Act.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4                 ARTICLE 1.  AGENCIES GIVEN 2001 SUNSET DATE

 1-5           SECTION 1.01.  Section 33.211, Natural Resources Code, is

 1-6     amended to read as follows:

 1-7           Sec. 33.211.  SUNSET PROVISION.  The Coastal Coordination

 1-8     Council is subject to Chapter 325, Government Code (Texas Sunset

 1-9     Act).  Unless continued in existence as provided by that chapter,

1-10     the council is abolished and this subchapter expires September 1,

1-11     2001 [1999].

1-12           SECTION 1.02.  Subchapter Y, Chapter 2306, Government Code,

1-13     as added by Chapter 76, Acts of the 74th Legislature, 1995, is

1-14     amended by adding Section 2306.5521 to read as follows:

1-15           Sec. 2306.5521.  SUNSET PROVISION.  The Texas Housing

1-16     Corporation is subject to Chapter 325 (Texas Sunset Act).  Unless

1-17     continued in existence as provided by that chapter, the corporation

1-18     is abolished and this subchapter expires September 1, 2001.

1-19           SECTION 1.03.  Section 2306.022, Government Code, is amended

1-20     to read as follows:

1-21           Sec. 2306.022.  APPLICATION OF SUNSET ACT.  The Texas

1-22     Department of Housing and Community Affairs is subject to Chapter

1-23     325 (Texas Sunset Act).  Unless continued in existence as provided

 2-1     by that chapter, the department is abolished and this chapter

 2-2     expires September 1, 2001 [1999].

 2-3           SECTION 1.04.  Section 2307.007, Government Code, is amended

 2-4     to read as follows:

 2-5           Sec. 2307.007.  SUNSET.  The Texas Interagency Council for

 2-6     the Homeless [council] is subject to Chapter 325 (Texas Sunset

 2-7     Act).  Unless continued in existence as provided by that chapter,

 2-8     the council is abolished and this chapter expires September 1, 2001

 2-9     [1999].

2-10                 ARTICLE 2.  AGENCIES GIVEN 2003 SUNSET DATE

2-11           SECTION 2.01.  Subsection (a), Section 74.127, Agriculture

2-12     Code, is amended to read as follows:

2-13           (a)  The board of directors of the official cotton growers'

2-14     boll weevil eradication foundation is subject to Chapter 325,

2-15     Government Code (Texas Sunset Act).  Unless continued in existence

2-16     as provided by that chapter, the board is abolished and this

2-17     subchapter expires September 1, 2003 [2004].

2-18           SECTION 2.02.  Subsection (a), Section 434.002, Government

2-19     Code, is amended to read as follows:

2-20           (a)  The Texas Veterans Commission is subject to Chapter 325

2-21     (Texas Sunset Act).  Unless continued in existence as provided by

2-22     that chapter, the commission is abolished September 1, 2003 [1999].

2-23           SECTION 2.03.  Section 752.025, Government Code, is amended

2-24     to read as follows:

2-25           Sec. 752.025.  SUNSET PROVISION.  The Governor's Advisory

 3-1     Committee on Immigration and Refugees is subject to Chapter 325,

 3-2     Government Code (Texas Sunset Act).  Unless continued in existence

 3-3     as provided by that chapter, the committee is abolished and this

 3-4     subchapter expires September 1, 2003 [1999].

 3-5           SECTION 2.04.  Subchapter B, Chapter 2003, Government Code,

 3-6     is amended by adding Section 2003.023 to read as follows:

 3-7           Sec. 2003.023.  SUNSET PROVISION.  The State Office of

 3-8     Administrative Hearings is subject to review under Chapter 325

 3-9     (Texas Sunset Act) but is not abolished under that chapter.  The

3-10     office shall be reviewed during the periods in which state agencies

3-11     abolished in 2003 and every 12th year after 2003 are reviewed.

3-12           SECTION 2.05.  Section 2152.002, Government Code, is amended

3-13     to read as follows:

3-14           Sec. 2152.002.  SUNSET PROVISION.  The General Services

3-15     Commission is subject to Chapter 325 (Texas Sunset Act).  Unless

3-16     continued in existence as provided by that chapter, the commission

3-17     is abolished and this subtitle expires September 1, 2003 [2001].

3-18           SECTION 2.06.  Section 2308.005, Government Code, is amended

3-19     to conform to Section 11.10, Chapter 655, Acts of the 74th

3-20     Legislature, 1995, and is further amended to read as follows:

3-21           Sec. 2308.005.  APPLICATION OF SUNSET ACT.  The Council on

3-22     Workforce and Economic Competitiveness is subject to Chapter 325

3-23     (Texas Sunset Act).  Unless continued in existence as provided by

3-24     that chapter, the council is abolished September 1, 2003 [1999].

3-25           SECTION 2.07.  Section 122.006, Human Resources Code, is

 4-1     amended to read as follows:

 4-2           Sec. 122.006.  SUNSET PROVISION.  The Texas Council on

 4-3     Purchasing from People with Disabilities is subject to Chapter 325,

 4-4     Government Code (Texas Sunset Act).  Unless continued in existence

 4-5     as provided by that chapter, the council is abolished and this

 4-6     chapter expires September 1, 2003 [1999].

 4-7           SECTION 2.08.  Section 301.008, Labor Code, is amended to

 4-8     read as follows:

 4-9           Sec. 301.008.  APPLICATION OF SUNSET ACT.  The Texas

4-10     Workforce Commission is subject to Chapter 325, Government Code

4-11     (Texas Sunset Act).  Unless continued in existence as provided by

4-12     that chapter, the commission is abolished September 1, 2003 [1999].

4-13           SECTION 2.09.  Subsection (b), Section 301.091, Labor Code,

4-14     is amended to read as follows:

4-15           (b)  The workforce development legislative oversight

4-16     committee is subject to Chapter 325, Government Code (Texas Sunset

4-17     Act).  Unless continued in existence as provided by that chapter,

4-18     the committee is abolished September 1, 2003 [1999].

4-19           SECTION 2.10.  Section 161.0111, Natural Resources Code, is

4-20     amended to read as follows:

4-21           Sec. 161.0111.  SUNSET PROVISION.  The Veterans' Land Board

4-22     is subject to review under Chapter 325, Government Code (Texas

4-23     Sunset Act), but is not abolished under that chapter.  The board

4-24     shall be reviewed during the period in which state agencies

4-25     abolished in 2003 [1999] and every 12th year after 2003 [1999] are

 5-1     reviewed.

 5-2                 ARTICLE 3.  AGENCIES GIVEN 2005 SUNSET DATE

 5-3           SECTION 3.01.  Subsection (b), Section 88.524, Education

 5-4     Code, is amended to read as follows:

 5-5           (b)  The Equine Research Account Advisory Committee is

 5-6     subject to Chapter 325, Government Code (Texas Sunset Act).  Unless

 5-7     continued in existence as provided by that chapter, the advisory

 5-8     committee is abolished and this subchapter expires September 1,

 5-9     2005 [2001].

5-10           SECTION 3.02.  Subsection (f), Section 3.606, Public Utility

5-11     Regulatory Act of 1995 (Article 1446c-0, Vernon's Texas Civil

5-12     Statutes), is amended to read as follows:

5-13           (f)  The Telecommunications Infrastructure Fund Board [board]

5-14     is subject to Chapters 551 and 2001, Government Code.  The board is

5-15     subject to Chapter 325, Government Code (Texas Sunset Act).  Unless

5-16     continued in existence as provided by that chapter, the [advisory]

5-17     board is abolished and this section expires [expire] September 1,

5-18     2005 [2006].

5-19                 ARTICLE 4.  AGENCIES GIVEN 1999 SUNSET DATE

5-20           SECTION 4.01.  Subsection (d), Section 4, Private

5-21     Investigators and Private Security Agencies Act (Article

5-22     4413(29bb), Vernon's Texas Civil Statutes), is amended to read as

5-23     follows:

5-24           (d)  The Texas Board of Private Investigators and Private

5-25     Security Agencies is subject to Chapter 325, Government Code (Texas

 6-1     Sunset Act).  Unless continued in existence as provided by that

 6-2     chapter, the board is abolished and this Act expires September 1,

 6-3     1999 [2003].

 6-4           SECTION 4.02.  The Sunset Advisory Commission shall perform

 6-5     the review of the Texas Board of Private Investigators and Private

 6-6     Security Agencies under Chapter 325, Government Code (Texas Sunset

 6-7     Act), in coordination with the office of the state auditor.

 6-8           SECTION 4.03.  Subsection (c), Section 411.002, Government

 6-9     Code, is amended to read as follows:

6-10           (c)  The Department of Public Safety of the State of Texas is

6-11     subject to Chapter 325 (Texas Sunset Act). Unless continued in

6-12     existence as provided by that chapter, the department is abolished

6-13     and Subsections (a) and (b) expire September 1, 1999 [2005].

6-14           SECTION 4.04.  The Department of Public Safety shall pay the

6-15     costs incurred by the Sunset Advisory Commission in performing the

6-16     review of the department under Subsection (c), Section 411.002,

6-17     Government Code, as amended by this Act.  The Sunset Advisory

6-18     Commission shall determine the amount of the costs, and the

6-19     department shall pay the amount promptly on receipt of a statement

6-20     from the commission showing the costs.

6-21           SECTION 4.05.  Section 419.003, Government Code, is amended

6-22     to read as follows:

6-23           Sec. 419.003.  Sunset Provision.  The Texas Commission on

6-24     Fire Protection is subject to Chapter 325 (Texas Sunset Act).

6-25     Unless continued in existence as provided by that chapter, the

 7-1     commission is abolished and this chapter expires September 1, 1999

 7-2     [1997].

 7-3           SECTION 4.06.  Section 443.002, Government Code, is amended

 7-4     to read as follows:

 7-5           Sec. 443.002.  Sunset Provision.  The State Preservation

 7-6     Board is subject to Chapter 325 (Texas Sunset Act).  Unless

 7-7     continued in existence as provided by that chapter, the board is

 7-8     abolished and this chapter expires September 1, 1999 [1997].

 7-9           SECTION 4.07.  Section 501.059, Government Code, is amended

7-10     by adding Subsection (q) to read as follows:

7-11           (q)  The Correctional Managed Health Care Advisory Committee

7-12     is subject to Chapter 325 (Texas Sunset Act).  Unless continued in

7-13     existence as provided by that chapter, the committee is abolished

7-14     and this section expires September 1, 1999.

7-15           SECTION 4.08.  Section 201.204, Transportation Code, is

7-16     amended to read as follows:

7-17           Sec. 201.204.  SUNSET PROVISION.  The Texas Department of

7-18     Transportation is subject to Chapter 325, Government Code (Texas

7-19     Sunset Act).  Unless continued in existence as provided by that

7-20     chapter, the department is abolished September 1, 1999 [1997].

7-21           SECTION 4.09.  Section 361.003, Transportation Code, is

7-22     amended to read as follows:

7-23           Sec. 361.003.  SUNSET PROVISION.  The Texas Turnpike

7-24     Authority is subject to Chapter 325, Government Code (Texas Sunset

7-25     Act).  Unless continued in existence as provided by that chapter,

 8-1     the authority is abolished and this chapter expires September 1,

 8-2     1999 [1997].

 8-3                   ARTICLE 5.  REMOVAL FROM SUNSET REVIEW

 8-4           SECTION 5.01.  Section 317.012, Government Code, which

 8-5     provides for the  review of the state budget execution law by the

 8-6     Sunset Advisory Commission, is repealed.

 8-7                    ARTICLE 6.  MISCELLANEOUS PROVISIONS

 8-8           SECTION 6.01.  (a)  Except as otherwise provided by this

 8-9     section, this Act takes effect September 1, 1997.

8-10           (b)  The section of this Act that amends Section 419.003,

8-11     Government Code, takes effect only if the 75th Legislature, Regular

8-12     Session, 1997, does not enact other legislation that becomes law

8-13     and that amends Section 419.003, Government Code, to extend the

8-14     sunset date of the Texas Commission on Fire Protection.

8-15           (c)  The section of this Act that amends Section 443.002,

8-16     Government Code, takes effect only if the 75th Legislature, Regular

8-17     Session, 1997, does not enact other legislation that becomes law

8-18     and that amends Section 443.002, Government Code, to extend the

8-19     sunset date of the State Preservation Board.

8-20           (d)  The section of this Act that amends Section 201.204,

8-21     Transportation Code, takes effect only if the 75th Legislature,

8-22     Regular Session, 1997, does not enact other legislation that

8-23     becomes law and that amends Section 201.204, Transportation Code,

8-24     to extend the sunset date of the Texas Department of

8-25     Transportation.

                                                                S.B. No. 360

 9-1           (e)  The section of this Act that amends Section 361.003,

 9-2     Transportation Code, takes effect only if the 75th Legislature,

 9-3     Regular Session, 1997, does not enact other legislation that

 9-4     becomes law and that amends Section 361.003, Transportation Code,

 9-5     to extend the sunset date of the Texas Turnpike Authority.

 9-6           SECTION 6.02.  The importance of this legislation and the

 9-7     crowded condition of the calendars in both houses create an

 9-8     emergency and an imperative public necessity that the

 9-9     constitutional rule requiring bills to be read on three several

9-10     days in each house be suspended, and this rule is hereby suspended.
