1-10     relating to the review and continuation of certain state agencies

1-11     and laws subject to the Texas Sunset Act.

1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-13                  ARTICLE 1.  AGENCY GIVEN 2001 SUNSET DATE

1-14           SECTION 1.01.  Section 33.211, Natural Resources Code, is

1-15     amended to read as follows:

1-16           Sec. 33.211.  SUNSET PROVISION.  The Coastal Coordination

1-17     Council is subject to Chapter 325, Government Code (Texas Sunset

1-18     Act).  Unless continued in existence as provided by that chapter,

1-19     the council is abolished and this subchapter expires September 1,

1-20     2001 [1999].

1-21                 ARTICLE 2.  AGENCIES GIVEN 2003 SUNSET DATE

1-22           SECTION 2.01.  Subsection (a), Section 74.127, Agriculture

1-23     Code, is amended to read as follows:

1-24           (a)  The board of directors of the official cotton growers'

1-25     boll weevil eradication foundation is subject to Chapter 325,

1-26     Government Code (Texas Sunset Act).  Unless continued in existence

1-27     as provided by that chapter, the board is abolished and this

1-28     subchapter expires September 1, 2003 [2004].

1-29           SECTION 2.02.  Subsection (a), Section 434.002, Government

1-30     Code, is amended to read as follows:

1-31           (a)  The Texas Veterans Commission is subject to Chapter 325

1-32     (Texas Sunset Act).  Unless continued in existence as provided by

1-33     that chapter, the commission is abolished September 1, 2003 [1999].

1-34           SECTION 2.03.  Section 752.025, Government Code, is amended

1-35     to read as follows:

1-36           Sec. 752.025.  SUNSET PROVISION.  The Governor's Advisory

1-37     Committee on Immigration and Refugees is subject to Chapter 325,

1-38     Government Code (Texas Sunset Act).  Unless continued in existence

1-39     as provided by that chapter, the committee is abolished and this

1-40     subchapter expires September 1, 2003 [1999].

1-41           SECTION 2.04.  Subchapter B, Chapter 2003, Government Code,

1-42     is amended by adding Section 2003.023 to read as follows:

1-43           Sec. 2003.023.  SUNSET PROVISION.  The State Office of

1-44     Administrative Hearings is subject to review under Chapter 325

1-45     (Texas Sunset Act) but is not abolished under that chapter.  The

1-46     office shall be reviewed during the periods in which state agencies

1-47     abolished in 2003 and every 12th year after 2003 are reviewed.

1-48           SECTION 2.05.  Section 2152.002, Government Code, is amended

1-49     to read as follows:

1-50           Sec. 2152.002.  SUNSET PROVISION.  The General Services

1-51     Commission is subject to Chapter 325 (Texas Sunset Act).  Unless

1-52     continued in existence as provided by that chapter, the commission

1-53     is abolished and this subtitle expires September 1, 2003 [2001].

1-54           SECTION 2.06.  Section 2306.022, Government Code, is amended

1-55     to read as follows:

1-56           Sec. 2306.022.  APPLICATION OF SUNSET ACT.  The Texas

1-57     Department of Housing and Community Affairs is subject to Chapter

1-58     325 (Texas Sunset Act).  Unless continued in existence as provided

1-59     by that chapter, the department is abolished and this chapter

1-60     expires September 1, 2003 [1999].

1-61           SECTION 2.07.  Section 2307.007, Government Code, is amended

1-62     to read as follows:

1-63           Sec. 2307.007.  SUNSET.  The Texas Interagency Council for

1-64     the Homeless [council] is subject to Chapter 325 (Texas Sunset

 2-1     Act).  Unless continued in existence as provided by that chapter,

 2-2     the council is abolished and this chapter expires September 1, 2003

 2-3     [1999].

 2-4           SECTION 2.08.  Section 2308.005, Government Code, is amended

 2-5     to conform to Section 11.10, Chapter 655, Acts of the 74th

 2-6     Legislature, 1995, and is further amended to read as follows:

 2-7           Sec. 2308.005.  APPLICATION OF SUNSET ACT.  The Council on

 2-8     Workforce and Economic Competitiveness is subject to Chapter 325

 2-9     (Texas Sunset Act).  Unless continued in existence as provided by

2-10     that chapter, the council is abolished September 1, 2003 [1999].

2-11           SECTION 2.09.  Section 122.006, Human Resources Code, is

2-12     amended to read as follows:

2-13           Sec. 122.006.  SUNSET PROVISION.  The Texas Council on

2-14     Purchasing from People with Disabilities is subject to Chapter 325,

2-15     Government Code (Texas Sunset Act).  Unless continued in existence

2-16     as provided by that chapter, the council is abolished and this

2-17     chapter expires September 1, 2003 [1999].

2-18           SECTION 2.10.  Section 301.008, Labor Code, is amended to

2-19     read as follows:

2-20           Sec. 301.008.  APPLICATION OF SUNSET ACT.  The Texas

2-21     Workforce Commission is subject to Chapter 325, Government Code

2-22     (Texas Sunset Act).  Unless continued in existence as provided by

2-23     that chapter, the commission is abolished September 1, 2003 [1999].

2-24           SECTION 2.11.  Subsection (b), Section 301.091, Labor Code,

2-25     is amended to read as follows:

2-26           (b)  The workforce development legislative oversight

2-27     committee is subject to Chapter 325, Government Code (Texas Sunset

2-28     Act).  Unless continued in existence as provided by that chapter,

2-29     the committee is abolished September 1, 2003 [1999].

2-30           SECTION 2.12.  Section 161.0111, Natural Resources Code, is

2-31     amended to read as follows:

2-32           Sec. 161.0111.  SUNSET PROVISION.  The Veterans' Land Board

2-33     is subject to review under Chapter 325, Government Code (Texas

2-34     Sunset Act), but is not abolished under that chapter.  The board

2-35     shall be reviewed during the period in which state agencies

2-36     abolished in 2003 [1999] and every 12th year after 2003 [1999] are

2-37     reviewed.

2-38                 ARTICLE 3.  AGENCIES GIVEN 2005 SUNSET DATE

2-39           SECTION 3.01.  Subsection (b), Section 88.524, Education

2-40     Code, is amended to read as follows:

2-41           (b)  The Equine Research Account Advisory Committee is

2-42     subject to Chapter 325, Government Code (Texas Sunset Act).  Unless

2-43     continued in existence as provided by that chapter, the advisory

2-44     committee is abolished and this subchapter expires September 1,

2-45     2005 [2001].

2-46           SECTION 3.02.  Section 106.003, Health and Safety Code, is

2-47     amended to read as follows:

2-48           Sec. 106.003.  SUNSET PROVISION.  The Center for Rural Health

2-49     Initiatives is subject to Chapter 325, Government Code (Texas

2-50     Sunset Act).  Unless continued in existence as provided by that

2-51     chapter, the center is abolished and this chapter expires September

2-52     1, 2005 [1999].

2-53           SECTION 3.03.  Subsection (f), Section 3.606, Public Utility

2-54     Regulatory Act of 1995 (Article 1446c-0, Vernon's Texas Civil

2-55     Statutes), is amended to read as follows:

2-56           (f)  The Telecommunications Infrastructure Fund Board [board]

2-57     is subject to Chapters 551 and 2001, Government Code.  The board is

2-58     subject to Chapter 325, Government Code (Texas Sunset Act).  Unless

2-59     continued in existence as provided by that chapter, the [advisory]

2-60     board is abolished and this section expires [expire] September 1,

2-61     2005 [2006].

2-62                   ARTICLE 4.  REMOVAL FROM SUNSET REVIEW

2-63           SECTION 4.01.  Section 317.012, Government Code, which

2-64     provides for the  review of the state budget execution law by the

2-65     Sunset Advisory Commission, is repealed.

2-66                    ARTICLE 5.  MISCELLANEOUS PROVISIONS

2-67           SECTION 5.01.  This Act takes effect September 1, 1997.

2-68           SECTION 5.02.  The importance of this legislation and the

2-69     crowded condition of the calendars in both houses create an

 3-1     emergency and an imperative public necessity that the

 3-2     constitutional rule requiring bills to be read on three several

 3-3     days in each house be suspended, and this rule is hereby suspended.
