1-7 COMMITTEE SUBSTITUTE FOR S.B. No. 625 By: Whitmire
1-8 AN ACT
1-9 relating to the dissemination of information contained in the
1-10 juvenile justice information system.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Section 58.106, Family Code, is amended by
1-13 amending Subsection (a) and adding Subsection (c) to read as
1-14 follows:
1-15 (a) Except as otherwise provided by this section [Subsection
1-16 (b)], information contained in the juvenile justice information
1-17 system is confidential information for the use of the department
1-18 and may not be disseminated by the department except:
1-19 (1) with the permission of the juvenile offender, to
1-20 military personnel of this state or the United States;
1-21 (2) to a person or entity to which the department may
1-22 grant access to adult criminal history records as provided by
1-23 Section 411.083, Government Code;
1-24 (3) to a juvenile justice agency; and
1-25 (4) to the Criminal Justice Policy Council, the Texas
1-26 Youth Commission, and the Texas Juvenile Probation Commission for
1-27 analytical purposes.
1-28 (c) The department may, if necessary to protect the welfare
1-29 of the community, disseminate to the public the following
1-30 information relating to a juvenile offender who has escaped from
1-31 the custody of the Texas Youth Commission:
1-32 (1) the juvenile offender's name, including other
1-33 names by which the juvenile offender is known;
1-34 (2) the juvenile offender's physical description,
1-35 including sex, weight, height, race, ethnicity, eye color, hair
1-36 color, scars, marks, and tattoos;
1-37 (3) a photograph of the juvenile offender; and
1-38 (4) the conduct for which the juvenile offender was
1-39 committed to the Texas Youth Commission, including the level and
1-40 degree of the alleged offense.
1-41 SECTION 2. The change in law made by this Act applies to
1-42 information contained in the juvenile justice information system
1-43 and collected by the Department of Public Safety of the State of
1-44 Texas before, on, or after the effective date of this Act.
1-45 SECTION 3. The importance of this legislation and the
1-46 crowded condition of the calendars in both houses create an
1-47 emergency and an imperative public necessity that the
1-48 constitutional rule requiring bills to be read on three several
1-49 days in each house be suspended, and this rule is hereby suspended,
1-50 and that this Act take effect and be in force from and after its
1-51 passage, and it is so enacted.
