1-6 COMMITTEE AMENDMENT NO. 1 By: Shapiro
1-7 Amend S.B. No. 691 by creating a new SECTION 1 to read as follows
1-8 and renumbering the subsequent sections accordingly:
1-9 SECTION 1. Subdivision (5), Section 2, Private Investigators
1-10 and Private Security Agencies Act (Article 4413(29bb), Vernon's
1-11 Texas Civil Statutes), is amended to read as follows:
1-12 (5) "Alarm systems company" means a [any] person who
1-13 [that sells,] installs, services, monitors, or responds to alarm
1-14 systems, burglar alarm signal devices, detection devices, burglar
1-15 alarms, robbery alarms, television cameras, or still cameras used
1-16 to signal the presence of an emergency or other hazard requiring
1-17 urgent attention and to which law enforcement or other emergency
1-18 services are expected to respond[, or any other electrical,
1-19 mechanical, or electronic device used:]
1-20 [(A) to prevent or detect burglary, theft,
1-21 robbery, shoplifting, pilferage, shrinkage, or other losses of that
1-22 type;]
1-23 [(B) to prevent or detect intrusion; or]
1-24 [(C) primarily to detect or summon aid for other
1-25 emergencies].
1-26 A BILL TO BE ENTITLED
1-27 AN ACT
1-28 relating to the regulation of a detection device under the Private
1-29 Investigators and Private Security Agencies Act.
1-30 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-31 SECTION 1. Subdivision (33), Section 2, Private
1-32 Investigators and Private Security Agencies Act (Article
1-33 4413(29bb), Vernon's Texas Civil Statutes), is amended to read as
1-34 follows:
1-35 (33) "Detection device" means an electronic device
1-36 used as a part of a burglar or hold-up alarm including any control,
1-37 communications, motion detector, door or window switch, sound
1-38 detector, vibration detector, light beam, pressure mat, wiring, or
1-39 similar device[; or any electronic device used to limit access by
1-40 persons into building structures or gate compounds, including any
1-41 control, communications, motion detector, door or window switch,
1-42 card or proximity readers, push-button key pad entry, gate entry
1-43 device, door exit buttons, or similar device].
1-44 SECTION 2. This Act takes effect September 1, 1997.
1-45 SECTION 3. The importance of this legislation and the
1-46 crowded condition of the calendars in both houses create an
1-47 emergency and an imperative public necessity that the
1-48 constitutional rule requiring bills to be read on three several
1-49 days in each house be suspended, and this rule is hereby suspended.
