                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to standing to enforce restrictions pertaining to state

 1-2     property.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter C, Chapter 31, Natural Resources Code,

 1-5     is amended by adding Section 31.068 to read as follows:

 1-6           Sec. 31.068.  STANDING TO ENFORCE RESTRICTIONS.  The

 1-7     commissioner and the attorney general have standing to enforce

 1-8     restrictive covenants affecting real property owned by the

 1-9     permanent school fund or a state agency and restrictions expressed

1-10     in any transfer document, or any legislative act, conveying real

1-11     property then owned by the state.  The attorney general acting on

1-12     his own, or on behalf of the commissioner, may bring suit to

1-13     enforce the rights of the state under this section.

1-14           SECTION 2.  The provisions of Section 1 of this Act shall not

1-15     apply to any cause of action pending before the courts of this

1-16     state on the effective date of this Act.

1-17           SECTION 3.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended,

1-22     and that this Act take effect and be in force from and after its

1-23     passage, and it is so enacted.
