                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to water quality protection zones.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Section 26.179, Water Code, as added by Chapter

 1-4     975, Acts of the 74th Legislature, 1995, is amended by adding

 1-5     Subsections (o) and (p) to read as follows:

 1-6           (o)  If a municipality's action results in part of a zone

 1-7     being located outside the municipality's extraterritorial

 1-8     jurisdiction, the entire zone is removed from the municipality's

 1-9     extraterritorial jurisdiction.  A zone removed from a

1-10     municipality's extraterritorial jurisdiction may not be brought

1-11     into the municipality's extraterritorial jurisdiction before the

1-12     20th anniversary of the date on which the zone was designated.

1-13           (p)  In addition to the fees authorized under Subsection (g),

1-14     the commission shall adopt and assess reasonable and necessary fees

1-15     adequate to recover the commission's costs in monitoring water

1-16     quality associated with water quality protection zones.

1-17           SECTION 2.  Section 1 of this Act applies to any action taken

1-18     by a municipality after January 1, 1997.

1-19           SECTION 3.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended,

 2-1     and that this Act take effect and be in force from and after its

 2-2     passage, and it is so enacted.
