 1-8                            A BILL TO BE ENTITLED

 1-9                                   AN ACT

1-10     relating to water quality protection zones.

1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-12           SECTION 1.  Section 26.179, Water Code, as added by Chapter

1-13     975, Acts of the 74th Legislature, 1995, is amended by adding

1-14     Subsections (o) and (p) to read as follows:

1-15           (o)  If a municipality's action results in part of a zone

1-16     being located outside the municipality's extraterritorial

1-17     jurisdiction, the entire zone is removed from the municipality's

1-18     extraterritorial jurisdiction.  A zone removed from a

1-19     municipality's extraterritorial jurisdiction may not be brought

1-20     into the municipality's extraterritorial jurisdiction before the

1-21     20th anniversary of the date on which the zone was designated.

1-22           (p)  In addition to the fees authorized under Subsection (g),

1-23     the commission shall adopt and assess reasonable and necessary fees

1-24     adequate to recover the commission's costs in monitoring water

1-25     quality associated with water quality protection zones.

1-26           SECTION 2.  Section 1 of this Act applies to any action taken

1-27     by a municipality after January 1, 1997.

1-28           SECTION 3.  The importance of this legislation and the

1-29     crowded condition of the calendars in both houses create an

1-30     emergency and an imperative public necessity that the

1-31     constitutional rule requiring bills to be read on three several

1-32     days in each house be suspended, and this rule is hereby suspended,

1-33     and that this Act take effect and be in force from and after its

1-34     passage, and it is so enacted.
