1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the change of name of Corpus Christi State University
1-9 to Texas A&M University--Corpus Christi and to eliminating certain
1-10 obsolete provisions relating to the university.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Section 55.1711, Education Code, is amended to
1-13 read as follows:
1-14 Sec. 55.1711. TEXAS A&M UNIVERSITY--CORPUS CHRISTI [CORPUS
1-15 CHRISTI STATE UNIVERSITY]. (a) The board of regents of The Texas
1-16 A&M University System may acquire, purchase, construct, improve,
1-17 enlarge, and equip property, buildings, structures, and facilities
1-18 for Texas A&M University--Corpus Christi [Corpus Christi State
1-19 University], including a classroom, a laboratory, and an office
1-20 facility; a central heating and air conditioning plant; roads,
1-21 sidewalks, landscaping, and related infrastructure; and a physical
1-22 education instructional facility. The board may finance said
1-23 facilities through the issuance of bonds pursuant to this
1-24 subchapter and in accordance with its existing system-wide revenue
1-25 financing program and may pledge irrevocably to the payment of such
1-26 bonds all or any part of the aggregate amount of student tuition
1-27 charges required or authorized by law to be imposed on students
1-28 enrolled at Texas A&M University--Corpus Christi [Corpus Christi
1-29 State University]; and the amount of any pledge so made shall never
1-30 be reduced or abrogated while such bonds, or bonds issued to refund
1-31 such bonds, are outstanding. Bonds issued pursuant to this
1-32 subsection may not be issued in an aggregate principal amount
1-33 exceeding $30 million.
1-34 (b) The bonds issued hereunder and the facilities financed
1-35 thereby shall be subject to all approvals then required by law.
1-36 SECTION 2. Subdivision (3), Section 61.003, Education Code,
1-37 is amended to read as follows:
1-38 (3) "General academic teaching institution" means The
1-39 University of Texas at Austin; The University of Texas at El Paso;
1-40 The University of Texas of the Permian Basin; The University of
1-41 Texas at Dallas; The University of Texas at San Antonio; Texas A&M
1-42 University, Main University; The University of Texas at Arlington;
1-43 Tarleton State College; Prairie View Agricultural and Mechanical
1-44 College; Texas Maritime Academy; Texas Tech University; University
1-45 of North Texas; Lamar University; Texas A&I University; Texas A&M
1-46 University--Corpus Christi; Texas Woman's University; Texas
1-47 Southern University; Midwestern University; University of Houston;
1-48 Pan American University; The University of Texas at Brownsville;
1-49 East Texas State University; Sam Houston State University;
1-50 Southwest Texas State University; West Texas State University;
1-51 Stephen F. Austin State University; Sul Ross State University;
1-52 Angelo State University; Tyler State College; and any other
1-53 college, university, or institution so classified as provided in
1-54 this chapter or created and so classified, expressly or impliedly,
1-55 by law.
1-56 SECTION 3. Subchapter E, Chapter 87, Education Code, is
1-57 amended to read as follows:
1-58 SUBCHAPTER E. TEXAS A&M UNIVERSITY--CORPUS CHRISTI
1-59 [CORPUS CHRISTI STATE UNIVERSITY]
1-60 Sec. 87.401. ESTABLISHMENT; SCOPE. (a) Texas A&M
1-61 University--Corpus Christi [Corpus Christi State University] is a
1-62 coeducational educational institution located in the city of Corpus
1-63 Christi. The upper-level institution is a component institution of
1-64 The Texas A&M University System and is under the management and
2-1 control of the board of regents of The Texas A&M University System.
2-2 (b) The board has the same powers and duties concerning
2-3 Texas A&M University--Corpus Christi [Corpus Christi State
2-4 University] as are conferred on it by statute concerning Texas A&M
2-5 University.
2-6 Sec. 87.402. Courses and Degrees; Rules; Joint Appointments.
2-7 (a) The board, with the approval of the Texas Higher Education
2-8 Coordinating Board, may prescribe courses leading to customary
2-9 degrees as are offered at leading American educational institutions
2-10 and may award those degrees, including baccalaureate, master's, and
2-11 doctoral degrees and their equivalents.
2-12 (b) A new department, school, or degree program may not be
2-13 instituted without the prior approval of the Texas Higher Education
2-14 Coordinating Board.
2-15 (c) The board shall adopt other rules for the operation,
2-16 control, and management of the institution, including the
2-17 determination of the number of students that may be admitted to any
2-18 school, college, or degree-granting program, as may be necessary
2-19 for the conduct of the institution as one of the first class.
2-20 (d) The board may make joint faculty appointments in Texas
2-21 A&M University--Corpus Christi [Corpus Christi State University]
2-22 and in other institutions under its governance. The salary of a
2-23 person who receives a joint appointment shall be apportioned to the
2-24 appointing institution on the basis of services rendered.
2-25 [Sec. 87.403. ADMISSION STANDARDS. Admission standards at
2-26 Corpus Christi State University for freshman- and sophomore-level
2-27 students must be comparable to the admission standards for
2-28 freshman- and sophomore-level students at public senior colleges
2-29 and universities that are members of the Southwest Conference.]
2-30 [Sec. 87.404. LIMITATIONS. (a) Corpus Christi State
2-31 University may not offer freshman and sophomore courses until the
2-32 fall semester, 1994.]
2-33 [(b) Freshman enrollment at Corpus Christi State University
2-34 shall be limited to:]
2-35 [(1) 400 students for 1994; and]
2-36 [(2) 500 students for 1995, unless a total enrollment
2-37 increase of 300 or more students occurs between the fall semester
2-38 of 1993 and the fall semester of 1994 at Texas A & I University and
2-39 at Del Mar College.]
2-40 SECTION 4. (a) A reference in law to Corpus Christi State
2-41 University means Texas A&M University--Corpus Christi.
2-42 (b) An appropriation for the use and benefit of Corpus
2-43 Christi State University is available for the use and benefit of
2-44 Texas A&M University--Corpus Christi.
2-45 SECTION 5. The importance of this legislation and the
2-46 crowded condition of the calendars in both houses create an
2-47 emergency and an imperative public necessity that the
2-48 constitutional rule requiring bills to be read on three several
2-49 days in each house be suspended, and this rule is hereby suspended,
2-50 and that this Act take effect and be in force from and after its
2-51 passage, and it is so enacted.
