                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the authority of certain counties to approve landfill

 1-3     sites.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter C, Chapter 361, Health and Safety

 1-6     Code, is amended by adding Section 361.116 to read as follows:

 1-7           Sec. 361.116.  COUNTY APPROVAL OF LANDFILL DISPOSAL SITE.

 1-8     (a)  This section applies only to an application for a permit

 1-9     related to a solid waste disposal landfill or landfill expansion

1-10     proposed for a location in a county with a population of 2.5

1-11     million or more.

1-12           (b)  The commission may not issue a permit for a solid waste

1-13     disposal landfill or an expansion of such a landfill unless the

1-14     commissioners court of the county in which the proposed site of the

1-15     landfill or expansion is located approves the proposed site by

1-16     written resolution.

1-17           SECTION 2.  Section 361.116, Health and Safety Code, as added

1-18     by this Act applies only to the issuance of a permit for a solid

1-19     waste disposal landfill or an expansion of such a landfill for

1-20     which the application is filed with the Texas Natural Resource

1-21     Conservation Commission on or after the effective date of this Act.

1-22           SECTION 3.  The importance of this legislation and the

1-23     crowded condition of the calendars in both houses create an

1-24     emergency and an imperative public necessity that the

 2-1     constitutional rule requiring bills to be read on three several

 2-2     days in each house be suspended, and this rule is hereby suspended,

 2-3     and that this Act take effect and be in force from and after its

 2-4     passage, and it is so enacted.
