A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the streamlining of the organizational structures of
1-3 state agencies.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Chapter 651, Government Code, is amended by
1-6 adding Section 651.004 to read as follows:
1-7 Sec. 651.004. MANAGEMENT-TO-STAFF RATIOS. (a) A state
1-8 agency shall develop procedures for use in achieving a
1-9 management-to-staff ratio of one manager for each 11 staff members.
1-10 (b) In this section, "state agency" has the meaning assigned
1-11 by Section 2052.101.
1-12 SECTION 2. Section 2052.103, Government Code, is amended by
1-13 amending Subsections (a) and (b) to read as follows:
1-14 (a) Not later than the last day of the first month following
1-15 each quarter of the fiscal year, a state agency shall file with the
1-16 state auditor a written report that provides for that fiscal
1-17 quarter:
1-18 (1) the number of full-time equivalent state employees
1-19 employed by the agency and paid from funds in the state treasury;
1-20 (2) the number of full-time equivalent state employees
1-21 employed by the agency and paid from funds outside of the state
1-22 treasury;
1-23 (3) the increase or decrease, if any, of the number of
1-24 full-time equivalent employees from the fiscal quarter preceding
2-1 the quarter covered by the report;
2-2 (4) the number of positions of the agency paid from
2-3 funds in the state treasury;
2-4 (5) the number of positions of the agency paid from
2-5 funds outside of the state treasury; [and]
2-6 (6) the number of individuals who performed services
2-7 for the agency under a contract, including consultants and
2-8 individuals employed under contracts with temporary help services;
2-9 and
2-10 (7) the number of managers, supervisors, and staff.
2-11 (b) The report must be made in the manner prescribed by the
2-12 state auditor and include:
2-13 (1) an annotated organizational chart depicting the
2-14 total number of full-time equivalent employees and the total number
2-15 of managers, supervisors, and staff for each functional area in the
2-16 state agency;
2-17 (2) the management-to-staff ratio for each functional
2-18 area; and
2-19 (3) a separate organizational chart that summarizes
2-20 the categories of employees in the agency's regional offices.
2-21 SECTION 3. This Act takes effect September 1, 1997.
2-22 SECTION 4. The importance of this legislation and the
2-23 crowded condition of the calendars in both houses create an
2-24 emergency and an imperative public necessity that the
2-25 constitutional rule requiring bills to be read on three several
2-26 days in each house be suspended, and this rule is hereby suspended.
