                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to reports required from certain producers and purchasers

 1-2     of oil.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subsection (a), Section 202.201, Tax Code, is

 1-5     amended to read as follows:

 1-6           (a)  A producer authorized by the comptroller to remit the

 1-7     tax due shall file with the comptroller, on or before the 25th day

 1-8     of each calendar month, the report under this subsection and, as

 1-9     applicable, the report under Subsection (d) showing the total oil

1-10     produced, used, lost or stolen, or possessed and otherwise

1-11     unaccounted for by the producer during the preceding calendar

1-12     month.  The report under this subsection must show:

1-13                 (1)  the number of barrels of oil produced from each

1-14     lease;

1-15                 (2)  each county [the counties] in which each lease

1-16     from which oil was produced is located;

1-17                 (3)  the name, address, and taxpayer identification

1-18     number assigned by the comptroller of each first purchaser of oil

1-19     and for each the amount of oil purchased from each lease;

1-20                 (4)  the payment [price, by amounts,] received for the

1-21     oil from [for] each first purchaser from each lease from which oil

1-22     was produced;

1-23                 (5)  the name and lease identification number of each

 2-1     [the] lease from which the oil was produced; and

 2-2                 (6)  other information the comptroller may reasonably

 2-3     require.

 2-4           SECTION 2.  Subsection (a), Section 202.202, Tax Code, is

 2-5     amended to read as follows:

 2-6           (a)  On or before the 25th day of each calendar month, each

 2-7     first purchaser or his authorized agent shall file a report with

 2-8     the comptroller.  The report must contain the following information

 2-9     concerning oil purchased from a producer during the preceding

2-10     calendar month:

2-11                 (1)  the number of barrels of oil purchased from each

2-12     lease for each producer;

2-13                 (2)  the amount [price] paid to each producer for each

2-14     lease from which [the] oil was purchased;

2-15                 (3)  the name and address of each producer;

2-16                 (4)  each county [the counties] in which each lease

2-17     from which the purchased oil was produced is located;

2-18                 (5)  the name and lease identification number of each

2-19     lease [names of the leases] from which the purchased oil was

2-20     produced; and

2-21                 (6)  other information the comptroller may reasonably

2-22     require.

2-23           SECTION 3.  This Act takes effect September 1, 1997, and

2-24     applies to a report due on or after that date.

2-25           SECTION 4.  The importance of this legislation and the

 3-1     crowded condition of the calendars in both houses create an

 3-2     emergency and an imperative public necessity that the

 3-3     constitutional rule requiring bills to be read on three several

 3-4     days in each house be suspended, and this rule is hereby suspended.

 3-6           Amend Section 3 of SB 988 to read as follows:

 3-7           SECTION 3.  This Act takes effect [September] January 1,

 3-8     [1997] 1998, and applies to a report due on or after that date.
