 1-6                            A BILL TO BE ENTITLED

 1-7                                   AN ACT

 1-8     relating to the charitable contributions of state employees.

 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-10           SECTION 1.  Subsection (e), Section 659.140, Government Code,

1-11     is amended to read as follows:

1-12           (e)  The state policy committee shall:

1-13                 (1)  establish local campaign areas based on

1-14     recommendations by the state advisory committee;

1-15                 (2)  select as [an eligible federated community

1-16     campaign organization to be] the state campaign manager:

1-17                       (A)  a federated community campaign organization;

1-18     or

1-19                       (B)  in the absence of an application by an

1-20     organization described by Paragraph (A), a charitable organization

1-21     determined by the state policy committee to have demonstrated the

1-22     capacity to conduct a state campaign;

1-23                 (3)  determine the eligibility of a federation or fund

1-24     and its affiliated agencies for statewide participation in the

1-25     state employee charitable campaign;

1-26                 (4)  approve the recommended campaign plan, budget, and

1-27     generic materials to be used by campaign managers;

1-28                 (5)  oversee the state employee charitable campaign to

1-29     ensure that all campaign activities are conducted fairly and

1-30     equitably to promote unified solicitation on behalf of all

1-31     participants; and

1-32                 (6)  perform other duties prescribed by the

1-33     comptroller's rules.

1-34           SECTION 2.  Subsection (e), Section 659.143, Government Code,

1-35     is amended to read as follows:

1-36           (e)  The local employee committee shall:

1-37                 (1)  select as the local campaign manager:

1-38                       (A)  [contract with] a federated community

1-39     campaign organization [to serve as the local campaign manager]; or

1-40                       (B)  in the absence of an application by an

1-41     organization described by Paragraph (A), a charitable organization

1-42     determined by the local employee committee to have demonstrated the

1-43     capacity to conduct a local campaign;

1-44                 (2)  determine the eligibility of local charitable

1-45     organizations to participate in the state employee charitable

1-46     campaign;

1-47                 (3)  in consultation with the local campaign manager,

1-48     approve the recommended campaign plan, budget, and generic

1-49     materials to be used by campaign managers;

1-50                 (4)  oversee the local state employee charitable

1-51     campaign to ensure that all local campaign activities are conducted

1-52     fairly and equitably to promote unified solicitation on behalf of

1-53     all participants; and

1-54                 (5)  perform other duties prescribed by the

1-55     comptroller's rules.

1-56           SECTION 3.  Subsection (b), Section 659.145, Government Code,

1-57     is amended to read as follows:

1-58           (b)  A member of the state advisory committee, the state

1-59     policy committee, or a local employee committee may not receive

1-60     compensation for serving on the committee and is not entitled to

1-61     reimbursement from state funds for expenses incurred in performing

1-62     functions as a member of the committee.

1-63           SECTION 4.  Subchapter H, Chapter 659, Government Code, is

1-64     amended by adding Section 659.153 to read as follows:

 2-1           Sec. 659.153.  LEGAL REPRESENTATION.  The attorney general

 2-2     shall represent the state policy committee and each local employee

 2-3     committee in all legal matters.

 2-4           SECTION 5.  This Act takes effect September 1, 1997.

 2-5           SECTION 6.  The importance of this legislation and the

 2-6     crowded condition of the calendars in both houses create an

 2-7     emergency and an imperative public necessity that the

 2-8     constitutional rule requiring bills to be read on three several

 2-9     days in each house be suspended, and this rule is hereby suspended.
