AN ACT

 1-1     relating to the change of the name of Texas A&I University to Texas

 1-2     A&M University--Kingsville.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  The heading to Subchapter D, Chapter 87,

 1-5     Education Code, is amended to read as follows:

 1-6               SUBCHAPTER D.  TEXAS A&M UNIVERSITY--KINGSVILLE

 1-7                              [A&I UNIVERSITY]

 1-8           SECTION 2.  Section 87.301, Education Code, is amended to

 1-9     read as follows:

1-10           Sec. 87.301.  ESTABLISHMENT.  (a)  Texas A&M

1-11     University--Kingsville [A&I University] is a coeducational

1-12     institution of higher education located in the city of Kingsville.

1-13     The university is a component institution of The Texas A&M

1-14     University System and is under the management and control of the

1-15     board of regents of The Texas A&M University System.

1-16           (b)  The board has the same powers and duties concerning

1-17     Texas A&M University--Kingsville [A&I University] as are conferred

1-18     on it by statute concerning Texas A&M University.

1-19           SECTION 3.  Subdivision (1), Section 51.502, Education Code,

1-20     is amended to read as follows:

1-21                 (1)  "Eligible institution" means the college,

1-22     department, or other unit of engineering at any of the following

1-23     institutions of higher education:

 2-1                       (A)  The University of Texas at Austin;

 2-2                       (B)  The University of Texas at Arlington;

 2-3                       (C)  The University of Texas at El Paso;

 2-4                       (D)  The University of Texas at San Antonio;

 2-5                       (E)  The University of Texas of the Permian

 2-6     Basin;

 2-7                       (F)  Texas A&M University;

 2-8                       (G)  Prairie View A&M University;

 2-9                       (H)  Texas Tech University;

2-10                       (I)  Lamar University;

2-11                       (J)  University of Houston; and

2-12                       (K)  Texas A&M University--Kingsville [A&I

2-13     University].

2-14           SECTION 4.  Subdivision (3), Section 61.003, Education Code,

2-15     is amended to read as follows:

2-16                 (3)  "General academic teaching institution" means The

2-17     University of Texas at Austin; The University of Texas at El Paso;

2-18     The University of Texas of the Permian Basin; The University of

2-19     Texas at Dallas; The University of Texas at San Antonio; Texas A&M

2-20     University, Main University; The University of Texas at Arlington;

2-21     Tarleton State University [College]; Prairie View A&M University

2-22     [Agricultural and Mechanical College]; Texas Maritime Academy;

2-23     Texas Tech University; University of North Texas; Lamar University;

2-24     Texas A&M University--Kingsville [A&I University]; Texas Woman's

2-25     University; Texas Southern University; Midwestern State University;

 3-1     University of Houston; University of Texas--Pan American [Pan

 3-2     American University]; The University of Texas at Brownsville; Texas

 3-3     A&M University--Commerce [East Texas State University]; Sam Houston

 3-4     State University; Southwest Texas State University; West Texas A&M

 3-5     [State] University; Stephen F. Austin State University; Sul Ross

 3-6     State University; Angelo State University; The University of Texas

 3-7     at Tyler [Tyler State College]; and any other college, university,

 3-8     or institution so classified as provided in this chapter or created

 3-9     and so classified, expressly or impliedly, by law.

3-10           SECTION 5.  Subsection (c), Section 85.70, Education Code, is

3-11     amended to read as follows:

3-12           (c)  The board shall lease for oil, gas, sulphur, or other

3-13     mineral development, as prescribed by this subchapter, all or part

3-14     of the land under the exclusive control of the board owned by the

3-15     State of Texas and acquired for the use of Texas A&M

3-16     University--Kingsville [A&I University] and its divisions.  Any

3-17     money received by the board concerning such land under this

3-18     subchapter shall be deposited in the state treasury to the credit

3-19     of a special fund to be known as the Texas A&M

3-20     University--Kingsville [A&I University] special mineral fund, to be

3-21     used exclusively for Texas A&M University--Kingsville [A&I

3-22     University] and its branches and divisions. Money may not be

3-23     expended from this fund except as authorized by the general

3-24     appropriations act.

3-25           SECTION 6.  Section 52.291, Natural Resources Code, is

 4-1     amended to read as follows:

 4-2           Sec. 52.291.  COVERAGE.  The following persons, agencies, and

 4-3     entities are subject to the provisions of Sections 52.292 through

 4-4     52.293 of this code:

 4-5                 (1)  the commissioner;

 4-6                 (2)  the board;

 4-7                 (3)  boards for lease of land owned by a department,

 4-8     board, or agency of the state created by Chapter 34 of this code;

 4-9                 (4)  the Board for Lease of University Lands;

4-10                 (5)  the Board of Regents of Texas A&M University;

4-11                 (6)  the Board of Regents of Texas Tech University;

4-12                 (7)  [the Board of Directors of Texas A&I University;]

4-13                 [(8)]  the Board of Regents of the Texas[,] State

4-14     University System [Senior Colleges];

4-15                 (8) [(9)]  the Board of Regents of the University of

4-16     Houston;

4-17                 (9) [(10)]  any other board of regents or other

4-18     governing board of a state-supported institution of higher learning

4-19     having authority to execute oil and gas leases on land owned by the

4-20     institution;

4-21                 (10) [(11)]  an owner of land or minerals in this state

4-22     whose authority to lease the land or minerals as agent for the

4-23     state arises in whole or in part from what is commonly known as the

4-24     Relinquishment Act, codified in Subchapter F of this chapter;

4-25                 (11) [(12)]  the Board for Lease of State Park Lands;

 5-1                 (12) [(13)]  the Board for Lease of the Texas

 5-2     Department of Criminal Justice [Corrections]; and

 5-3                 (13) [(14)]  the commissioners court of any county in

 5-4     this state.

 5-5           SECTION 7.  Subsection (e), Section 12.1105, Parks and

 5-6     Wildlife Code, is amended to read as follows:

 5-7           (e)  The Parks and Wildlife Department, when requested by

 5-8     authorized representatives of units of The University of Texas

 5-9     System, The Texas A&M University System, [the Texas A&I University

5-10     System, Pan American University,] and the Texas State University

5-11     System engaged in teaching and research related to marine science

5-12     and oceanography, may transfer to such units of said universities

5-13     and university systems nets, seines, and other marine equipment,

5-14     which have been seized under this section, to be used in carrying

5-15     out the teaching and research programs within said institutions.

5-16           SECTION 8.  (a)  A reference in law to Texas A&I University

5-17     means Texas A&M University--Kingsville.

5-18           (b)  An appropriation for the use and benefit of Texas A&I

5-19     University is available for the use and benefit of Texas A&M

5-20     University--Kingsville.

5-21           SECTION 9.  The importance of this legislation and the

5-22     crowded condition of the calendars in both houses create an

5-23     emergency and an imperative public necessity that the

5-24     constitutional rule requiring bills to be read on three several

5-25     days in each house be suspended, and this rule is hereby suspended,

 6-1     and that this Act take effect and be in force from and after its

 6-2     passage, and it is so enacted.
