 1-7                                   AN ACT

 1-8     relating to the change of the name of Texas A&I University to Texas

 1-9     A&M University--Kingsville.

1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-11           SECTION 1.  The heading to Subchapter D, Chapter 87,

1-12     Education Code, is amended to read as follows:

1-13               SUBCHAPTER D.  TEXAS A&M UNIVERSITY--KINGSVILLE

1-14                              [A&I UNIVERSITY]

1-15           SECTION 2.  Section 87.301, Education Code, is amended to

1-16     read as follows:

1-17           Sec. 87.301.  ESTABLISHMENT.  (a)  Texas A&M

1-18     University--Kingsville [A&I University] is a coeducational

1-19     institution of higher education located in the city of Kingsville.

1-20     The university is a component institution of The Texas A&M

1-21     University System and is under the management and control of the

1-22     board of regents of The Texas A&M University System.

1-23           (b)  The board has the same powers and duties concerning

1-24     Texas A&M University--Kingsville [A&I University] as are conferred

1-25     on it by statute concerning Texas A&M University.

1-26           SECTION 3.  Subdivision (1), Section 51.502, Education Code,

1-27     is amended to read as follows:

1-28                 (1)  "Eligible institution" means the college,

1-29     department, or other unit of engineering at any of the following

1-30     institutions of higher education:

1-31                       (A)  The University of Texas at Austin;

1-32                       (B)  The University of Texas at Arlington;

1-33                       (C)  The University of Texas at El Paso;

1-34                       (D)  The University of Texas at San Antonio;

1-35                       (E)  The University of Texas of the Permian

1-36     Basin;

1-37                       (F)  Texas A&M University;

1-38                       (G)  Prairie View A&M University;

1-39                       (H)  Texas Tech University;

1-40                       (I)  Lamar University;

1-41                       (J)  University of Houston; and

1-42                       (K)  Texas A&M University--Kingsville [A&I

1-43     University].

1-44           SECTION 4.  Subdivision (3), Section 61.003, Education Code,

1-45     is amended to read as follows:

1-46                 (3)  "General academic teaching institution" means The

1-47     University of Texas at Austin; The University of Texas at El Paso;

1-48     The University of Texas of the Permian Basin; The University of

1-49     Texas at Dallas; The University of Texas at San Antonio; Texas A&M

1-50     University, Main University; The University of Texas at Arlington;

1-51     Tarleton State University [College]; Prairie View A&M University

1-64     and so classified, expressly or impliedly, by law.

 2-1           SECTION 5.  Subsection (c), Section 85.70, Education Code, is

 2-2     amended to read as follows:

 2-3           (c)  The board shall lease for oil, gas, sulphur, or other

 2-4     mineral development, as prescribed by this subchapter, all or part

 2-5     of the land under the exclusive control of the board owned by the

 2-6     State of Texas and acquired for the use of Texas A&M

 2-7     University--Kingsville [A&I University] and its divisions.  Any

 2-8     money received by the board concerning such land under this

 2-9     subchapter shall be deposited in the state treasury to the credit

2-10     of a special fund to be known as the Texas A&M

2-11     University--Kingsville [A&I University] special mineral fund, to be

2-12     used exclusively for Texas A&M University--Kingsville [A&I

2-13     University] and its branches and divisions. Money may not be

2-14     expended from this fund except as authorized by the general

2-15     appropriations act.

2-16           SECTION 6.  Section 52.291, Natural Resources Code, is

2-17     amended to read as follows:

2-18           Sec. 52.291.  COVERAGE.  The following persons, agencies, and

2-19     entities are subject to the provisions of Sections 52.292 through

2-20     52.293 of this code:

2-21                 (1)  the commissioner;

2-22                 (2)  the board;

2-23                 (3)  boards for lease of land owned by a department,

2-24     board, or agency of the state created by Chapter 34 of this code;

2-25                 (4)  the Board for Lease of University Lands;

2-26                 (5)  the Board of Regents of Texas A&M University;

2-27                 (6)  the Board of Regents of Texas Tech University;

2-28                 (7)  [the Board of Directors of Texas A&I University;]

2-29                 [(8)]  the Board of Regents of the Texas[,] State

2-30     University System [Senior Colleges];

2-31                 (8) [(9)]  the Board of Regents of the University of

2-32     Houston;

2-33                 (9) [(10)]  any other board of regents or other

2-34     governing board of a state-supported institution of higher learning

2-35     having authority to execute oil and gas leases on land owned by the

2-36     institution;

2-37                 (10) [(11)]  an owner of land or minerals in this state

2-38     whose authority to lease the land or minerals as agent for the

2-39     state arises in whole or in part from what is commonly known as the

2-40     Relinquishment Act, codified in Subchapter F of this chapter;

2-41                 (11) [(12)]  the Board for Lease of State Park Lands;

2-42                 (12) [(13)]  the Board for Lease of the Texas

2-43     Department of Criminal Justice [Corrections]; and

2-44                 (13) [(14)]  the commissioners court of any county in

2-45     this state.

2-46           SECTION 7.  Subsection (e), Section 12.1105, Parks and

2-47     Wildlife Code, is amended to read as follows:

2-48           (e)  The Parks and Wildlife Department, when requested by

2-49     authorized representatives of units of The University of Texas

2-50     System, The Texas A&M University System, [the Texas A&I University

2-51     System, Pan American University,] and the Texas State University

2-52     System engaged in teaching and research related to marine science

2-53     and oceanography, may transfer to such units of said universities

2-54     and university systems nets, seines, and other marine equipment,

2-55     which have been seized under this section, to be used in carrying

2-56     out the teaching and research programs within said institutions.

2-57           SECTION 8.  (a)  A reference in law to Texas A&I University

2-58     means Texas A&M University--Kingsville.

2-59           (b)  An appropriation for the use and benefit of Texas A&I

2-60     University is available for the use and benefit of Texas A&M

2-61     University--Kingsville.

2-62           SECTION 9.  The importance of this legislation and the

2-63     crowded condition of the calendars in both houses create an

2-64     emergency and an imperative public necessity that the

2-65     constitutional rule requiring bills to be read on three several

2-66     days in each house be suspended, and this rule is hereby suspended,

2-67     and that this Act take effect and be in force from and after its

2-68     passage, and it is so enacted.
