                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the use of a private building for a polling place.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Subsection (d), Section 43.031, Election Code, is

 1-4     amended to read as follows:

 1-5           (d)  If a suitable public building is unavailable, the

 1-6     polling place may be located in some other building, and any charge

 1-7     for its use is an election expense.  A polling place may not be

 1-8     located in a building under this subsection unless electioneering

 1-9     is permitted on the building's premises outside the prescribed

1-10     limits within which electioneering is prohibited.

1-11           SECTION 2.  This Act takes effect September 1, 1997.

1-12           SECTION 3.  The importance of this legislation and the

1-13     crowded condition of the calendars in both houses create an

1-14     emergency and an imperative public necessity that the

1-15     constitutional rule requiring bills to be read on three several

1-16     days in each house be suspended, and this rule is hereby suspended.
