                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to exempting the children of disabled firemen and peace

 1-3     officers from the payment of tuition and fees at state-supported

 1-4     institutions of higher education.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 54.204(e), Education Code, is amended to

 1-7     read as follows:

 1-8           (e)  A person entitled to an exemption under [the provisions

 1-9     of] this section may use the exemption at any institution of higher

1-10     education.  A person may not receive an exemption under this

1-11     section for more than four semesters at a public junior college[:]

1-12                 [(1)  only at the public senior college or university

1-13     which he first attends under the provisions of this section; or]

1-14                 [(2)  only at the public junior college which he first

1-15     attends, and upon successful completion of four consecutive

1-16     semesters at the public junior college he may continue to use the

1-17     exemption for four consecutive semesters only at the public senior

1-18     college or university which he subsequently first attends].

1-19           SECTION 2.  This Act applies to tuition and fees beginning

1-20     with the 1997 fall semester.

1-21           SECTION 3.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses create an

1-23     emergency and an imperative public necessity that the

1-24     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended,

 2-2     and that this Act take effect and be in force from and after its

 2-3     passage, and it is so enacted.
