No. 1268 97S0563/1 A BILL TO BE ENTITLED AN ACT 1-1 relating to disclosure of driver's license record information held 1-2 by the Department of Public Safety of the State of Texas. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subsection (a), Section 521.046, Transportation 1-5 Code, is amended to read as follows: 1-6 (a) In addition to the information authorized to be released 1-7 under Section 521.045, on receipt of a written request and payment 1-8 of a $6 fee, the department may disclose that information and 1-9 information regarding each reported motor vehicle moving violation, 1-10 as defined by department rule, resulting in a traffic law 1-11 conviction and each motor vehicle accident in which the individual 1-12 received a citation, by date and location, within the three years 1-13 preceding the date of the request, to a person who: 1-14 (1) demonstrates a legitimate need for the 1-15 information; and 1-16 (2) submits to the department the individual's 1-17 driver's license number or the individual's full name and date of 1-18 birth. 1-19 SECTION 2. This Act takes effect September 1, 1997. 1-20 SECTION 3. The importance of this legislation and the 1-21 crowded condition of the calendars in both houses create an 1-22 emergency and an imperative public necessity that the 1-23 constitutional rule requiring bills to be read on three several 2-1 days in each house be suspended, and this rule is hereby suspended.
