 1-6                            A BILL TO BE ENTITLED

 1-7                                   AN ACT

 1-8     relating to disclosure of driver's license record information held

 1-9     by the Department of Public Safety of the State of Texas.

1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-11           SECTION 1.  Subsection (a), Section 521.046, Transportation

1-12     Code, is amended to read as follows:

1-13           (a)  In addition to the information authorized to be released

1-14     under Section 521.045, on receipt of a written request and payment

1-15     of a $6 fee, the department may disclose that information and

1-16     information regarding each reported motor vehicle moving violation,

1-17     as defined by department rule, resulting in a traffic law

1-18     conviction and each motor vehicle accident in which the individual

1-19     received a citation, by date and location, within the three years

1-20     preceding the date of the request, to a person who:

1-21                 (1)  demonstrates a legitimate need for the

1-22     information; and

1-23                 (2)  submits to the department the individual's

1-24     driver's license number or the individual's full name and date of

1-25     birth.

1-26           SECTION 2.  This Act takes effect September 1, 1997.

1-27           SECTION 3.  The importance of this legislation and the

1-28     crowded condition of the calendars in both houses create an

1-29     emergency and an imperative public necessity that the

1-30     constitutional rule requiring bills to be read on three several

1-31     days in each house be suspended, and this rule is hereby suspended.
