 1-6                            A BILL TO BE ENTITLED

 1-7                                   AN ACT

 1-8     relating to historic structures, including the restoration and

 1-9     preservation of historic structures by a municipality.

1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-11           SECTION 1.  Section 271.0461, Local Government Code, is

1-12     amended to read as follows:

1-13           Sec. 271.0461.  ADDITIONAL PURPOSE FOR CERTIFICATES:

1-14     DEMOLITION OF DANGEROUS STRUCTURES OR RESTORATION OF HISTORIC

1-15     STRUCTURES.  Certificates may be issued by any municipality for the

1-16     payment of contractual obligations to be incurred in demolishing

1-17     dangerous structures or restoring historic structures and may be

1-18     sold for cash, subject to the restrictions and other conditions of

1-19     Section 271.050.

1-20           SECTION 2.  Section 442.001, Government Code, is amended to

1-21     read as follows:

1-22           Sec. 442.001.  DEFINITION.  In this chapter, "historic

1-23     structure" means a structure that:

1-24                 (1)  is included on the National Register of Historic

1-25     Places;

1-26                 (2)  is designated as a Recorded Texas Historic

1-27     Landmark;

1-28                 (3)  is designated as a State Archeological Landmark;

1-29                 (4)  is determined by the Texas Historical Commission

1-30     to qualify as eligible property under criteria for inclusion on the

1-31     National Register of Historic Places or for designation as a

1-32     Recorded Texas Historic Landmark or as a State Archeological

1-33     Landmark; [or]

1-34                 (5)  is certified by the Texas Historical Commission to

1-35     other state agencies as worthy of preservation; or

1-36                 (6)  is designated by a municipal ordinance as

1-37     historic.

1-38           SECTION 3.  The importance of this legislation and the

1-39     crowded condition of the calendars in both houses create an

1-40     emergency and an imperative public necessity that the

1-41     constitutional rule requiring bills to be read on three several

1-42     days in each house be suspended, and this rule is hereby suspended,

1-43     and that this Act take effect and be in force from and after its

1-44     passage, and it is so enacted.
