 1-6                            A BILL TO BE ENTITLED

 1-7                                   AN ACT

 1-8     relating to reporting concerning fundraising for governor for a day

 1-9     and speaker's reunion day ceremonies.

1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-11           SECTION 1.  Subsection (a), Section 303.005, Government Code,

1-12     is amended to read as follows:

1-13           (a)  Not later than the 60th day after the date on which the

1-14     governor for a day or speaker's reunion day ceremony occurs, the

1-15     chairman shall file with the Texas Ethics Commission [secretary of

1-16     state] a final report indicating:

1-17                 (1)  the name and address of each contributor of more

1-18     than $50;

1-19                 (2)  the amount of each contribution of more than $50;

1-20                 (3)  whether a contribution of more than $50 was in

1-21     cash or in kind;

1-22                 (4)  the total of all contributions of $50 or less;

1-23                 (5)  the total of all contributions received;

1-24                 (6)  the name and address of each entity to which an

1-25     expenditure of more than $50 was made;

1-26                 (7)  the amount of each expenditure of more than $50;

1-27                 (8)  the purpose of each expenditure of more than $50;

1-28                 (9)  the total of all expenditures of $50 or less; and

1-29                 (10)  the total of all expenditures.

1-30           SECTION 2.  Subsection (b), Section 571.030, Government Code,

1-31     is amended to read as follows:

1-32           (b)  Money in the fund may be appropriated only to the

1-33     commission to administer and enforce:

1-34                 (1)  this chapter;

1-35                 (2)  Chapters 302, 303, 305, and 572; and

1-36                 (3)  Title 15, Election Code.

1-37           SECTION 3.  Subsection (a), Section 571.061, Government Code,

1-38     is amended to read as follows:

1-39           (a)  The commission shall administer and enforce:

1-40                 (1)  Chapters 302, 303, 305, and 572; and

1-41                 (2)  Title 15, Election Code.

1-42           SECTION 4.  Subsection (a), Section 571.091, Government Code,

1-43     is amended to read as follows:

1-44           (a)  The commission shall prepare a written opinion answering

1-45     the request of a person subject to any of the following laws for an

1-46     opinion about the application of any of these laws to the person in

1-47     regard to a specified existing or hypothetical factual situation:

1-48                 (1)  Chapter 302;

1-49                 (2)  Chapter 303;

1-50                 (3)  Chapter 305;

1-51                 (4) [(3)]  Chapter 572;

1-52                 (5) [(4)]  Title 15, Election Code;

1-53                 (6) [(5)]  Chapter 36, Penal Code; or

1-54                 (7) [(6)]  Chapter 39, Penal Code.

1-55           SECTION 5.  This Act takes effect September 1, 1997.

1-56           SECTION 6.  Not later than September 15, 1997, the secretary

1-57     of state shall transfer to the Texas Ethics Commission each final

1-58     report filed with the secretary of state under Subsection (a),

1-59     Section 303.005, Government Code, as that section existed before

1-60     amendment by this Act, that indicates that there is outstanding

1-61     debt and as to which a supplemental report under Subsection (b),

1-62     Section 303.005, Government Code, has not been filed with the

1-63     secretary of state.  A person required to file a supplemental

1-64     report under Subsection (b), Section 303.005, Government Code, who

 2-1     filed a final report under Subsection (a), Section 303.005,

 2-2     Government Code, as that section existed before amendment by this

 2-3     Act, with the secretary of state shall file the supplemental report

 2-4     with the Texas Ethics Commission.

 2-5           SECTION 7.  The importance of this legislation and the

 2-6     crowded condition of the calendars in both houses create an

 2-7     emergency and an imperative public necessity that the

 2-8     constitutional rule requiring bills to be read on three several

 2-9     days in each house be suspended, and this rule is hereby suspended.
