                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to compensation of school district trustees.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Subsection (d), Section 11.061, Education Code,

 1-4     is amended to read as follows:

 1-5           (d)  The trustees serve without compensation, unless

 1-6     compensation of a specified amount, not to exceed $500 annually and

 1-7     not from any state or federal funds, is approved by a majority of

 1-8     the votes cast at an election held by the district.  The trustees

 1-9     may not hold an election solely for the purpose of submitting a

1-10     measure on trustee compensation to the voters.  Notwithstanding

1-11     this subsection, a trustee may not receive compensation if the

1-12     trustee:

1-13                 (1)  holds an office other than the position of trustee

1-14     that is considered a civil office of emolument under Section 40,

1-15     Article XVI, Texas Constitution; or

1-16                 (2)  receives other compensation directly or indirectly

1-17     from the state.

1-18           SECTION 2.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

1-22     days in each house be suspended, and this rule is hereby suspended,

1-23     and that this Act take effect and be in force from and after its

 2-1     passage, and it is so enacted.
