                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the teacher hearing process.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Chapter 21, Subchapter F, Section 21.253,

 1-4     Education Code, is amended by adding a new section so that it reads

 1-5     as follows:

 1-6           A teacher must file a written request for a hearing under

 1-7     this subchapter with the commissioner not later than the 15th day

 1-8     after the date the teacher receives written notice of the proposed

 1-9     action.  The teacher must provide the district with a copy of the

1-10     request.  The Commissioner of Education shall exercise final

1-11     jurisdiction involving disputes relating to timeliness of teacher

1-12     appeals.

1-13           SECTION 2.  This Act applies beginning with the 1997-1998

1-14     school year.

1-15           SECTION 3.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended,

1-20     and that this Act take effect and be in force from and after its

1-21     passage, and it is so enacted.
