                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the addition of certain professional school personnel

 1-2     to the state minimum salary schedule.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 21.402, Education Code, is amended to

 1-5     read as follows:

 1-6           Sec. 21.402.  MINIMUM SALARY SCHEDULE FOR PROFESSIONAL

 1-7     PERSONNEL [CLASSROOM TEACHERS AND FULL-TIME LIBRARIANS].

 1-8     (a)  Except as provided by Subsection (d) or (e), a school district

 1-9     must pay each professional employee as defined in Subsection (g)

1-10     [classroom teacher or full-time librarian] not less than the

1-11     minimum monthly salary, based on the employee's level of

1-12     experience, determined by the following formula:

1-14     where:

1-15           "MS" is the minimum monthly salary;

1-16           "SF" is the applicable salary factor specified by Subsection

1-17     (c);

1-18           "FSP" is the amount appropriated in the General

1-19     Appropriations Act for the fiscal year for the Foundation School

1-20     Program, as determined by the commissioner as provided by

1-21     Subsection (b); and

1-22           "ADA" is the total estimated average daily attendance, as

1-23     defined by Section 42.005, used for purposes of the General

 2-1     Appropriations Act for the fiscal year.

 2-2           (b)  Not later than June 1 of each year, the commissioner

 2-3     shall determine the amount appropriated for purposes of Chapter 42

 2-4     for the state fiscal year beginning September 1.  The commissioner

 2-5     shall exclude from the determination:

 2-6                 (1)  amounts designated solely for use in connection

 2-7     with school facilities or for payment of principal of and interest

 2-8     on bonds; and

 2-9                 (2)  local funds received under Subchapter D, Chapter

2-10     41.

2-11           (c)  The salary factors per step are as follows:

2-18           (d)  If the minimum monthly salary determined under

2-19     Subsection (a) for a particular level of experience is less than

2-20     the minimum monthly salary for that level of experience in the

2-21     preceding year, the minimum monthly salary is the minimum monthly

2-22     salary for the preceding year.

2-23           (e)  Notwithstanding Subsection (a), a professional employee

2-24     [teacher or librarian] who received a career ladder supplement on

2-25     August 31, 1993, is entitled to at least the same gross monthly

2-26     salary the professional employee [teacher or librarian] received

2-27     for the 1994-1995 school year as long as the professisonal employee

 3-1     [teacher or librarian] is employed by the same district.

 3-2           (f)  In this section, "gross monthly salary" must include the

 3-3     amount a professional employee [teacher or librarian] received that

 3-4     represented a career ladder salary supplement under Section 16.057,

 3-5     as that section existed January 1, 1993.

 3-6           (g)  In this section, "professional employee" means an

 3-7     administrator, a supervisor, a classroom teacher, a counselor, a

 3-8     librarian, or another full-time professional employee who is

 3-9     required to hold a certificate issued under Subchapter B, or a

3-10     nurse.

3-11           SECTION 2.  This Act takes effect September 1, 1997.

3-12           SECTION 3.  The importance of this legislation and the

3-13     crowded condition of the calendars in both houses create an

3-14     emergency and an imperative public necessity that the

3-15     constitutional rule requiring bills to be read on three several

3-16     days in each house be suspended, and this rule is hereby suspended.
