                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to an exemption from the industrial solid waste

 1-2     collection, handling, storage, processing, and disposal permitting

 1-3     process for such activities on land owned or controlled by the

 1-4     source of the waste.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Subsection (a), Section 361.090, Health and

 1-7     Safety Code, is amended to read as follows:

 1-8           (a)  The commission may not require a permit under this

 1-9     chapter for the collection, handling, storage, processing, and

1-10     disposal of industrial solid waste generated in the state that is

1-11     collected, handled, stored, or processed [disposed of] within the

1-12     boundaries of a tract of land that is:

1-13                 (1)  owned or otherwise effectively controlled by the

1-14     owners or operators of the particular industrial plant,

1-15     manufacturing plant, mining operation, or agricultural operation

1-16     from which the waste results or is produced; and

1-17                 (2)  only in the case of disposal, located within 50

1-18     miles from the plant or operation that is the source of the

1-19     industrial solid waste.

1-20           SECTION 2.  This Act takes effect September 1, 1997.

1-21           SECTION 3.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses create an

1-23     emergency and an imperative public necessity that the

 2-1     constitutional rule requiring bills to be read on three several

 2-2     days in each house be suspended, and this rule is hereby suspended.
