                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to an exemption from the industrial solid waste

 1-2     collection, handling, storage, and processing permitting process

 1-3     for such activities on land owned or controlled by the source of

 1-4     the waste.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Chapter 361, Texas Health & Safety Code, is

 1-7     amended by amending Section 361.090(a) to read as follows:

 1-8           Sec. 361.090.  Regulation and Permitting of Certain

 1-9     Industrial Solid Waste Disposal.  (a)  The commission may not

1-10     require a permit under this chapter for the collection, handling,

1-11     storage, processing, and disposal of industrial solid waste that is

1-12     [disposed of] collected, handled, stored, or processed within the

1-13     boundaries of a tract of land that is:

1-14                 (1)  owned or otherwise effectively controlled by the

1-15     owners or operators of the particular industrial plant,

1-16     manufacturing plant, mining operation, or agricultural operation

1-17     from which the waste results or is produced; and

1-18                 (2)  only in the case of disposal, located within 50

1-19     miles from the plant or operation that is the source of the

1-20     industrial solid waste.

1-21           SECTION 2.  This Act takes effect September 1, 1997.

 2-1           SECTION 3.  The importance of this legislation and the

 2-2     crowded condition of the calendars in both houses create an

 2-3     emergency and an imperative public necessity that the

 2-4     constitutional rule requiring bills to be read on three several

 2-5     days in each house be suspended, and this rule is hereby suspended.
