1-6 COMMITTEE AMENDMENT NO. 1 By: Brown
1-7 Amend S.B. No. 1464 in SECTION 1, Subsection (a), Section 361.090,
1-8 Health and Safety Code, to read as follows:
1-9 (a) The commission may not require a permit under this
1-10 chapter for the collection, handling, storage, processing, and
1-11 disposal of industrial solid waste generated in the state that is
1-12 collected, handled, stored, or processed [disposed of] within the
1-13 boundaries of a tract of land that is:
1-14 (1) owned or otherwise effectively controlled by the
1-15 owners or operators of the particular industrial plant,
1-16 manufacturing plant, mining operation, or agricultural operation
1-17 from which the waste results or is produced; and
1-18 (2) only in the case of disposal, located within 50
1-19 miles from the plant or operation that is the source of the
1-20 industrial solid waste.
1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to an exemption from the industrial solid waste
1-24 collection, handling, storage, processing, and disposal permitting
1-25 process for such activities on land owned or controlled by the
1-26 source of the waste.
1-27 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-28 SECTION 1. Subsection (a), Section 361.090, Health and
1-29 Safety Code, is amended to read as follows:
1-30 (a) The commission may not require a permit under this
1-31 chapter for the collection, handling, storage, processing, and
1-32 disposal of industrial solid waste that is collected, handled,
1-33 stored, or processed [disposed of] within the boundaries of a tract
1-34 of land that is:
1-35 (1) owned or otherwise effectively controlled by the
1-36 owners or operators of the particular industrial plant,
1-37 manufacturing plant, mining operation, or agricultural operation
1-38 from which the waste results or is produced; and
1-39 (2) only in the case of disposal, located within 50
1-40 miles from the plant or operation that is the source of the
1-41 industrial solid waste.
1-42 SECTION 2. This Act takes effect September 1, 1997.
1-43 SECTION 3. The importance of this legislation and the
1-44 crowded condition of the calendars in both houses create an
1-45 emergency and an imperative public necessity that the
1-46 constitutional rule requiring bills to be read on three several
1-47 days in each house be suspended, and this rule is hereby suspended.
