                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the ex officio members of the Texas Racing Commission.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 2.02(a), Texas Racing Act (Article 179e,

 1-5     Vernon's Texas Civil Statutes), is amended to read as follows:

 1-6           (a)  The commission consists of six members appointed by the

 1-7     governor with the advice and consent of the senate and two ex

 1-8     officio members who shall have the right to vote.  The ex officio

 1-9     members are the chairman of the Public Safety Commission or a

1-10     member of the Public Safety Commission designated by the chairman

1-11     of the Public Safety Commission and the comptroller of public

1-12     accounts.  In making appointments to the commission, the governor

1-13     shall strive to achieve representation by all the population groups

1-14     of the state with regard to economic status, sex, race, and

1-15     ethnicity.

1-16           SECTION 2.  This Act takes effect September 1, 1997.

1-17           SECTION 3.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended.
