                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the determination of the amount of child support for a

 1-2     child of certain retired or disabled obligors.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter C, Chapter 154, Family Code, is

 1-5     amended by adding Section 154.132 to read as follows:

 1-6           Sec. 154.132.  DETERMINATION OF CHILD SUPPORT FOR CHILDREN OF

 1-7     CERTAIN RETIRED OR DISABLED OBLIGORS.  In determining the amount of

 1-8     child support to be paid by an obligor for a child, the court is

 1-9     not required to include or offset against the obligor's child

1-10     support obligation the amount or the value of social security

1-11     retirement child benefits or social security disability child

1-12     benefits paid or payable to the child.

1-13           SECTION 2.  This Act takes effect September 1, 1997.

1-14           SECTION 3.  The importance of this legislation and the

1-15     crowded condition of the calendars in both houses create an

1-16     emergency and an imperative public necessity that the

1-17     constitutional rule requiring bills to be read on three several

1-18     days in each house be suspended, and this rule is hereby suspended.
