                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the determination of the amount of child support for a

 1-2     child of certain retired or disabled obligors.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter C, Chapter 154, Family Code, is

 1-5     amended by adding Section 154.132 to read as follows:

 1-6           Sec. 154.132.  DETERMINATION OF CHILD SUPPORT FOR CHILDREN OF

 1-7     CERTAIN RETIRED OR DISABLED OBLIGORS.  In determining the amount of

 1-8     child support to be paid by an obligor, the court when calculating

 1-9     child support benefits, is not required to, INCLUDE social security

1-10     benefits paid to or for the child as a result of the obligor's

1-11     retirement or disability.

1-12           SECTION 2.  This Act takes effect September 1, 1997.

1-13           SECTION 3.  The importance of this legislation and the

1-14     crowded condition of the calendars in both houses create an

1-15     emergency and an imperative public necessity that the

1-16     constitutional rule requiring bills to be read on three several

1-17     days in each house be suspended, and this rule is hereby suspended.
