1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to source reduction and waste minimization plans for
1-9 electrical energy production and transmission.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 361.504, Health and Safety Code, is
1-12 amended to read as follows:
1-13 Sec. 361.504. APPLICATION. (a) Except as provided by
1-14 Subsection (b), this subchapter applies to the following persons:
1-15 (1) all large-quantity generators of hazardous waste;
1-16 (2) all generators other than large-quantity
1-17 generators and conditionally exempt small-quantity generators; and
1-18 (3) facilities [persons] subject to Section 313, Title
1-19 III, Superfund Amendments and Reauthorization Act of 1986 (42
1-20 U.S.C. Section 11023), excluding Standard Industrial Classification
1-21 Code 49, whose releases exceed the levels established under Section
1-22 361.503(b).
1-23 (b) The commission by rule shall establish one or more
1-24 schedules for the application of the requirements of this
1-25 subchapter to designated classes of persons described by Subsection
1-26 (a). The schedule shall provide for the inclusion of all persons
1-27 described by Subsection (a) on a date to be determined by the
1-28 commission, and until that date this subchapter applies only to
1-29 those persons designated by rule of the commission.
1-30 (c) This subchapter does not apply to a facility regulated
1-31 by the Railroad Commission of Texas under Section 91.101 or
1-32 141.012, Natural Resources Code.
1-33 SECTION 2. This Act takes effect September 1, 1997.
1-34 SECTION 3. The importance of this legislation and the
1-35 crowded condition of the calendars in both houses create an
1-36 emergency and an imperative public necessity that the
1-37 constitutional rule requiring bills to be read on three several
1-38 days in each house be suspended, and this rule is hereby suspended.
