                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the retention of certain medical records.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Subchapter E, Medical Practices Act (Article

 1-4     4495b, Vernon's Texas Civil Statutes), is amended by adding Section

 1-5     5.085 to read as follows:

 1-6           Sec. 5.085.  DUTY TO MAINTAIN MEDICAL RECORDS.  (a)  A

 1-7     license holder shall maintain all medical records and charts until

 1-8     the fifteenth anniversary of the date of the last entry in the

 1-9     record or chart.

1-10           (b)  A license holder may not be subject to disciplinary

1-11     action for an act or failure to act based on a medical record the

1-12     license holder is not required to maintain under this section.
