                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the sale of state owned real property under the

 1-2     management of the Texas Department of Criminal Justice and the

 1-3     disposition of the sales proceeds.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subsection (a) of Section 496.0021, Government

 1-6     Code, is amended to read as follows:

 1-7           Section 496.0021.  Sales of Department Real Property.

 1-8           (a)  The board may sell state-owned real property under the

 1-9     board's management and control at the real property's fair market

1-10     value.  The General Land Office shall negotiate and close a

1-11     transaction under this section on behalf of the board using

1-12     procedures under Section 31.158(c), Natural Resources Code.

1-13     Proceeds from the transaction shall be deposited in the General

1-14     Revenue Fund [Texas capital trust fund].

1-15           SECTION 2.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended,

1-20     and that this Act take effect and be in force from and after its

1-21     passage, and it is so enacted.
