A BILL TO BE ENTITLED
AN ACT
1-1 relating to the prohibition of minors on premises where alcoholic
1-2 beverages are sold.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Chapter 106, Alcoholic Beverage Code, is amended
1-5 by adding Section 106.021 to read as follows:
1-6 Sec. 106.021. Prohibition of a Minor on the premises of a
1-7 licensee or permittee
1-8 (a) Except as provided in Subsection (b) of this section, a
1-9 minor commits an offense if he is on the premises of a licensee or
1-10 permittee whose annual alcohol sales are in excess of 75 percent of
1-11 the gross receipts of the premises.
1-12 (b) A minor may be on the premises of a licensee or
1-13 permittee if:
1-14 (1) the minor is an employee of the licensee or
1-15 permittee and the employment is not prohibited by this code; or
1-16 (2) the minor is in the presence of an adult parent,
1-17 guardian, or adult spouse, or other adult to whom he has been
1-18 committed by a court.
1-19 (c) Except as provided in subsection (d) of this section, a
1-20 violation of this section is a Class C misdemeanor.
1-21 (d) If a person has been previously convicted of a violation
2-1 of this section or Sections 106.04 or 106.05 of this code, a
2-2 violation is a Class B misdemeanor except that no jail sentence may
2-3 be imposed for this violation.
2-4 SECTION 2. The importance of this legislation and the
2-5 crowded condition of the calendars in both houses create an
2-6 emergency and an imperative public necessity that the
2-7 constitutional rule requiring bills to be read on three several
2-8 days in each house be suspended, and this rule is hereby suspended,
2-9 and that this Act take effect and be in force from and after its
2-10 passage, and it is so enacted.
