No. 1795 1-2 (In the Senate - Filed March 14, 1997; March 24, 1997, read 1-3 first time and referred to Committee on Finance; April 18, 1997, 1-4 reported favorably by the following vote: Yeas 10, Nays 0; 1-5 April 18, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the taxable value of property of a school district that 1-9 does not offer each grade level from kindergarten to 12th grade. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter B, Chapter 42, Education Code, is 1-12 amended by adding Section 42.106 to read as follows: 1-13 Sec. 42.106. ADJUSTED PROPERTY VALUE FOR DISTRICTS NOT 1-14 OFFERING ALL GRADE LEVELS. For purposes of this chapter, the 1-15 taxable value of property of a school district that contracts for 1-16 students residing in the district to be educated in another 1-17 district under Section 25.039(a) is adjusted by applying the 1-18 formula: 1-20 where: 1-21 "ADPV" is the district's adjusted taxable value of property; 1-22 "DPV" is the taxable value of property in the district for 1-23 the preceding tax year determined under Subchapter M, Chapter 403, 1-24 Government Code; and 1-25 "TN" is the total amount of tuition required to be paid by 1-26 the district under Section 25.038 for the school year for which the 1-27 adjustment is made. 1-28 SECTION 2. This Act takes effect September 1, 1997. 1-29 SECTION 3. The importance of this legislation and the 1-30 crowded condition of the calendars in both houses create an 1-31 emergency and an imperative public necessity that the 1-32 constitutional rule requiring bills to be read on three several 1-33 days in each house be suspended, and this rule is hereby suspended. 1-34 * * * * *
