A BILL TO BE ENTITLED
AN ACT
1-1 relating to the dissolution of the San Elizario Grant Municipal
1-2 Utility District and the transfer of its territory, assets, and
1-3 liabilities to the Lower Valley Water District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. DEFINITIONS. In this Act:
1-6 (1) "Board" means the board of directors of the Lower
1-7 Valley Water District.
1-8 (2) "Commission" means the Texas Natural Resource
1-9 Conservation Commission.
1-10 (3) "District" means the Lower Valley Water District.
1-11 (4) "SEGMUD" means the San Elizario Grant Municipal
1-12 Utility District.
1-13 (5) "SEGMUD board" means the board of directors of the
1-14 San Elizario Grant Municipal Utility District.
1-15 SECTION 2. FINDINGS RELATING TO DISSOLUTION. The
1-16 legislature finds that:
1-17 (1) the district is a large municipal utility district
1-18 with a territory that encompasses approximately one-fourth of the
1-19 southeastern part of El Paso County;
1-20 (2) SEGMUD is a small, debt-free municipal utility
1-21 district with a territory that encompasses approximately 1,754.86
1-22 acres;
1-23 (3) the territory of SEGMUD is surrounded entirely by
1-24 the territory of the district;
2-1 (4) the district is in the process of expanding the
2-2 district's water and wastewater system to serve the area of San
2-3 Elizario located in El Paso County;
2-4 (5) the district will be capable of providing water
2-5 service within SEGMUD territory in the near future;
2-6 (6) SEGMUD provides water service within its territory
2-7 under a water supply contract with the El Paso County Water Control
2-8 and Improvement District No. 4;
2-9 (7) the SEGMUD board has adopted a resolution that:
2-10 (A) proposes to dissolve SEGMUD and to add
2-11 SEGMUD territory to the district; and
2-12 (B) directs SEGMUD's officials and consultants
2-13 to cooperate with the district's officials and consultants for
2-14 purposes of dissolving SEGMUD and adding its territory to the
2-15 district;
2-16 (8) the board has adopted a resolution that:
2-17 (A) supports the SEGMUD board's proposal to
2-18 dissolve SEGMUD and to add its territory to the district; and
2-19 (B) directs the district's officials and
2-20 consultants to cooperate with SEGMUD's officials and consultants
2-21 for purposes of dissolving SEGMUD and adding its territory to the
2-22 district; and
2-23 (9) dissolving SEGMUD and adding its territory to the
2-24 district benefits the public interest.
2-25 SECTION 3. AMENDMENT. Subsection (a), Section 2, Chapter
2-26 780, Acts of the 69th Legislature, Regular Session, 1985, is
2-27 amended to read as follows:
3-1 (a) The authority shall include all of the territory
3-2 contained within the following described areas:
3-3 Beginning at the most southerly point of the incorporated boundary
3-4 of the City of El Paso, Texas, said point also being common to the
3-5 United States Mexico boundary;
3-6 Thence, Northerly following along the existing city limits boundary
3-7 a distance of 6.0 miles (approximately) to the North right-of-way
3-8 line of U.S. Interstate 10;
3-9 Thence, Easterly following along the North right-of-way line of

15-1 SECTION 4. FINDING RELATING TO BOUNDARY DESCRIPTION. The
15-2 legislature finds that the territory of the district, as described
15-3 by Subsection (a), Section 2, Chapter 780, Acts of the 69th
15-4 Legislature, Regular Session, 1985, as amended by this Act, forms a
15-5 closure. If a mistake is made in copying the field notes during
15-6 the legislative process or if a mistake exists in the field notes,
15-7 the mistake does not affect:
15-8 (1) the organization, operation, existence, or
15-9 validity of the district;
15-10 (2) the district's right to issue bonds, including
15-11 refunding bonds, or to pay the principal and interest on bonds; or
15-12 (3) the district's right to assess, levy, and collect
15-13 taxes.
15-14 SECTION 5. FINDINGS RELATING TO BENEFIT. The legislature
15-15 finds that:
15-16 (1) the territory of the district, as described by
15-17 Subsection (a), Section 2, Chapter 780, Acts of the 69th
15-18 Legislature, Regular Session, 1985, as amended by this Act, and the
15-19 property located within that territory, is benefited by the works
15-20 and projects of the district; and
15-21 (2) the district serves a public use and benefit.
15-22 SECTION 6. CONDITIONS FOR DISSOLUTION AND TERRITORY CHANGE
15-23 ORDER. The board and the SEGMUD board may jointly request the
15-24 commission to enter an order dissolving SEGMUD and adding its
15-25 territory to the district if:
15-26 (1) the SEGMUD board, by resolution, consents to
15-27 dissolving SEGMUD and adding its territory to the district;
16-1 (2) the SEGMUD board holds an election in the same
16-2 manner as provided for bond elections under Section 49.106, Water
16-3 Code, for the qualified voters of SEGMUD to decide whether to
16-4 assume the outstanding bonds, including voted but unissued bonds,
16-5 notes, taxes, or other obligations of the district;
16-6 (3) a majority of the qualified voters participating
16-7 in an election held under Subdivision (2) of this section vote in
16-8 favor of assuming the outstanding bonds, including voted but
16-9 unissued bonds, notes, taxes, or other obligations of the district;
16-10 (4) SEGMUD enters into an agreement with the district
16-11 to transfer to the district:
16-12 (A) SEGMUD's debts, if any, liabilities, and
16-13 obligations; and
16-14 (B) SEGMUD's assets and facilities;
16-15 (5) the district completes construction of facilities
16-16 necessary to provide water service within SEGMUD territory;
16-17 (6) the district possesses adequate water capacity and
16-18 pressure to provide water service within SEGMUD territory; and
16-19 (7) the district enters into an agreement with SEGMUD
16-20 to:
16-21 (A) assume SEGMUD's debts, if any, liabilities,
16-22 and obligations;
16-23 (B) assume SEGMUD's assets and facilities; and
16-24 (C) provide water service within SEGMUD
16-25 territory.
16-26 SECTION 7. DISSOLUTION AND TERRITORY CHANGE ORDER; FILING
16-27 REQUIREMENT. (a) On receipt of a joint request under Section 6 of
17-1 this Act, the commission shall enter an order dissolving SEGMUD and
17-2 adding its territory to the district if the commission determines
17-3 that the conditions of Section 6 of this Act are satisfied.
17-4 (b) The commission shall file a copy of an order issued
17-5 under Subsection (a) of this section in the deed records of El
17-6 Paso County.
17-7 (c) Notwithstanding any other law, an order issued under
17-8 Subsection (a) of this section is effective to dissolve SEGMUD and
17-9 to add its territory to the district.
17-10 SECTION 8. EFFECTIVE DATE OF DISSOLUTION AND TERRITORY
17-11 CHANGE. (a) The dissolution of SEGMUD and the territory change of
17-12 the district as described by Section 7 of this Act becomes
17-13 effective on the date the commission files a copy of the
17-14 dissolution and territory change order as required by Subsection
17-15 (b) of Section 7 of this Act.
17-16 (b) On the effective date of dissolution and territory
17-17 change:
17-18 (1) all property and other assets of SEGMUD are
17-19 transferred to the district; and
17-20 (2) all debts, if any, liabilities, and other
17-21 obligations of SEGMUD are assumed by the district.
17-22 SECTION 9. CONTESTED CASE EXCEPTION. An order issued under
17-23 Subsection (a) of Section 7 of this Act is not a contested case for
17-24 purposes of Chapter 2001, Government Code.
17-25 SECTION 10. FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.
17-26 (a) The proper and legal notice of the intention to introduce this
17-27 Act, setting forth the general substance of this Act, has been
18-1 published as provided by law, and the notice and a copy of this Act
18-2 have been furnished to all persons, agencies, officials, or
18-3 entities to which they are required to be furnished by the
18-4 constitution and other laws of this state, including the governor,
18-5 who has submitted the notice and Act to the Texas Natural Resource
18-6 Conservation Commission.
18-7 (b) The Texas Natural Resource Conservation Commission has
18-8 filed its recommendations relating to this Act with the governor,
18-9 lieutenant governor, and speaker of the house of representatives
18-10 within the required time.
18-11 (c) All requirements of the constitution and laws of this
18-12 state and the rules and procedures of the legislature with respect
18-13 to the notice, introduction, and passage of this Act are fulfilled
18-14 and accomplished.
18-15 SECTION 11. RULES OF CONSTRUCTION. (a) A finding that a
18-16 provision of this Act is invalid does not affect the validity of
18-17 the remaining provisions of this Act.
18-18 (b) This Act shall be given a liberal and broad construction
18-19 to carry out the expressed purposes of this Act.
18-20 SECTION 12. EFFECTIVE DATE OF SECTION 3. The change in law
18-21 made by Section 3 of this Act takes effect on the date on which the
18-22 Texas Natural Resource Conservation Commission files a copy of the
18-23 dissolution and territory change order in the deed records of El
18-24 Paso County as required by Subsection (b) of Section 7 of this Act.
18-25 SECTION 13. EMERGENCY. The importance of this legislation
18-26 and the crowded condition of the calendars in both houses create an
18-27 emergency and an imperative public necessity that the
19-1 constitutional rule requiring bills to be read on three several
19-2 days in each house be suspended, and this rule is hereby suspended,
19-3 and that this Act take effect and be in force from and after its
19-4 passage, and it is so enacted.
