 1-9                                   AN ACT

1-10     relating to the dissolution of the San Elizario Grant Municipal

1-11     Utility District and the transfer of its territory, assets, and

1-12     liabilities to the Lower Valley Water District.

1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-14           SECTION 1.  DEFINITIONS.  In this Act:

1-15                 (1)  "Board" means the board of directors of the Lower

1-16     Valley Water District.

1-17                 (2)  "Commission" means the Texas Natural Resource

1-18     Conservation Commission.

1-19                 (3)  "District" means the Lower Valley Water District.

1-20                 (4)  "SEGMUD" means the San Elizario Grant Municipal

1-21     Utility District.

1-22                 (5)  "SEGMUD board" means the board of directors of the

1-23     San Elizario Grant Municipal Utility District.

1-24           SECTION 2.  FINDINGS RELATING TO DISSOLUTION.  The

1-25     legislature finds that:

1-26                 (1)  the district is a large municipal utility district

1-27     with a territory that encompasses approximately one-fourth of the

1-28     southeastern part of El Paso County;

1-29                 (2)  SEGMUD is a small, debt-free municipal utility

1-30     district with a territory that encompasses approximately 1,754.86

1-31     acres;

1-32                 (3)  the territory of SEGMUD is surrounded entirely by

1-33     the territory of the district;

1-34                 (4)  the district is in the process of expanding the

1-35     district's water and wastewater system to serve the area of San

1-36     Elizario located in El Paso County;

1-37                 (5)  the district will be capable of providing water

1-38     service within SEGMUD territory in the near future;

1-39                 (6)  SEGMUD provides water service within its territory

1-40     under a water supply contract with the El Paso County Water Control

1-41     and Improvement District No. 4;

1-42                 (7)  the SEGMUD board has adopted a resolution that:

1-43                       (A)  proposes to dissolve SEGMUD and to add

1-44     SEGMUD territory to the district; and

1-45                       (B)  directs SEGMUD's officials and consultants

1-46     to cooperate with the district's officials and consultants for

1-47     purposes of dissolving SEGMUD and adding its territory to the

1-48     district;

1-49                 (8)  the board has adopted a resolution that:

1-50                       (A)  supports the SEGMUD board's proposal to

1-51     dissolve SEGMUD and to add its territory to the district; and

1-52                       (B)  directs the district's officials and

1-53     consultants to cooperate with SEGMUD's officials and consultants

1-54     for purposes of dissolving SEGMUD and adding its territory to the

1-55     district; and

1-56                 (9)  dissolving SEGMUD and adding its territory to the

1-57     district benefits the public interest.

1-58           SECTION 3.  AMENDMENT. Subsection (a), Section 2, Chapter

1-59     780, Acts of the 69th Legislature, Regular Session, 1985, is

1-60     amended to read as follows:

1-61           (a)  The authority shall include all of the territory

1-62     contained within the following described areas:

1-63     Beginning at the most southerly point of the incorporated boundary

1-64     of the City of El Paso, Texas, said point also being common to the

 2-1     United States Mexico boundary;

 2-2     Thence, Northerly following along the existing city limits boundary

 2-3     a distance of 6.0 miles (approximately) to the North right-of-way

 2-4     line of U.S. Interstate 10;

 2-5     Thence, Easterly following along the North right-of-way line of

 2-6     U.S. Interstate 10 a distance of .85 miles (approximately) to a

 2-7     point;

 2-8     Thence, Northerly along the boundary of the Horizon Water District

 2-9     a distance of 1.2 miles (approximately) to a point on the common

6-45           SECTION 4.  FINDING RELATING TO BOUNDARY DESCRIPTION. The

6-46     legislature finds that the territory of the district, as described

6-47     by Subsection (a), Section 2, Chapter 780, Acts of the 69th

6-48     Legislature, Regular Session, 1985, as amended by this Act, forms a

6-49     closure.  If a mistake is made in copying the field notes during

6-50     the legislative process or if a mistake exists in the field notes,

6-51     the mistake does not affect:

6-52                 (1)  the organization, operation, existence, or

6-53     validity of the district;

6-54                 (2)  the district's right to issue bonds, including

6-55     refunding bonds, or to pay the principal and interest on bonds; or

6-56                 (3)  the district's right to assess, levy, and collect

6-57     taxes.

6-58           SECTION 5.  FINDINGS RELATING TO BENEFIT. The legislature

6-59     finds that:

6-60                 (1)  the territory of the district, as described by

6-61     Subsection (a), Section 2, Chapter 780, Acts of the 69th

6-62     Legislature, Regular Session, 1985, as amended by this Act, and the

6-63     property located within that territory, is benefited by the works

6-64     and projects of the district; and

6-65                 (2)  the district serves a public use and benefit.

6-66           SECTION 6.  CONDITIONS FOR DISSOLUTION AND TERRITORY CHANGE

6-67     ORDER.  The board and the SEGMUD board may jointly request the

6-68     commission to enter an order dissolving SEGMUD and adding its

6-69     territory to the district if:

 7-1                 (1)  the SEGMUD board, by resolution, consents to

 7-2     dissolving SEGMUD and adding its territory to the district;

 7-3                 (2)  the SEGMUD board holds an election in the same

 7-4     manner as provided for bond elections under Section 49.106, Water

 7-5     Code, for the qualified voters of SEGMUD to decide whether to

 7-6     assume the outstanding bonds, including voted but unissued bonds,

 7-7     notes, taxes, or other obligations of the district;

 7-8                 (3)  a majority of the qualified voters participating

 7-9     in an election held under Subdivision (2) of this section vote in

7-10     favor of assuming the outstanding bonds, including voted but

7-11     unissued bonds, notes, taxes, or other obligations of the district;

7-12                 (4)  SEGMUD enters into an agreement with the district

7-13     to transfer to the district:

7-14                       (A)  SEGMUD's debts, if any, liabilities, and

7-15     obligations; and

7-16                       (B)  SEGMUD's assets and facilities;

7-17                 (5)  the district completes construction of facilities

7-18     necessary to provide water service within SEGMUD territory;

7-19                 (6)  the district possesses adequate water capacity and

7-20     pressure to provide water service within SEGMUD territory; and

7-21                 (7)  the district enters into an agreement with SEGMUD

7-22     to:

7-23                       (A)  assume SEGMUD's debts, if any, liabilities,

7-24     and obligations;

7-25                       (B)  assume SEGMUD's assets and facilities; and

7-26                       (C)  provide water service within SEGMUD

7-27     territory.

7-28           SECTION 7.  DISSOLUTION AND TERRITORY CHANGE ORDER; FILING

7-29     REQUIREMENT.  (a)  On receipt of a joint request under Section 6 of

7-30     this Act, the commission shall enter an order dissolving SEGMUD and

7-31     adding its territory to the district if the commission determines

7-32     that the conditions of Section 6 of this Act are satisfied.

7-33           (b)  The commission shall file a copy of an order issued

7-34     under Subsection (a)  of this section in the deed records of El

7-35     Paso County.

7-36           (c)  Notwithstanding any other law, an order issued under

7-37     Subsection (a) of this section is effective to dissolve SEGMUD and

7-38     to add its territory to the district.

7-39           SECTION 8.  EFFECTIVE DATE OF DISSOLUTION AND TERRITORY

7-40     CHANGE.  (a)  The dissolution of SEGMUD and the territory change of

7-41     the district as described by Section 7 of this Act becomes

7-42     effective on the date the commission files a copy of the

7-43     dissolution and territory change order as required by Subsection

7-44     (b) of Section 7 of this Act.

7-45           (b)  On the effective date of dissolution and territory

7-46     change:

7-47                 (1)  all property and other assets of SEGMUD are

7-48     transferred to the district; and

7-49                 (2)  all debts, if any, liabilities, and other

7-50     obligations of SEGMUD are assumed by the district.

7-51           SECTION 9.  CONTESTED CASE EXCEPTION.  An order issued under

7-52     Subsection (a) of Section 7 of this Act is not a contested case for

7-53     purposes of Chapter 2001, Government Code.

7-54           SECTION 10.  FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.

7-55     (a)  The proper and legal notice of the intention to introduce this

7-56     Act, setting forth the general substance of this Act, has been

7-57     published as provided by law, and the notice and a copy of this Act

7-58     have been furnished to all persons, agencies, officials, or

7-59     entities to which they are required to be furnished by the

7-60     constitution and other laws of this state, including the governor,

7-61     who has submitted the notice and Act to the Texas Natural Resource

7-62     Conservation Commission.

7-63           (b)  The Texas Natural Resource Conservation Commission has

7-64     filed its recommendations relating to this Act with the governor,

7-65     lieutenant governor, and speaker of the house of representatives

7-66     within the required time.

7-67           (c)  All requirements of the constitution and laws of this

7-68     state and the rules and procedures of the legislature with respect

7-69     to the notice, introduction, and passage of this Act are fulfilled

 8-1     and accomplished.

 8-2           SECTION 11.  RULES OF CONSTRUCTION.  (a)  A finding that a

 8-3     provision of this Act is invalid does not affect the validity of

 8-4     the remaining provisions of this Act.

 8-5           (b)  This Act shall be given a liberal and broad construction

 8-6     to carry out the expressed purposes of this Act.

 8-7           SECTION 12.  EFFECTIVE DATE OF SECTION 3.  The change in law

 8-8     made by Section 3 of this Act takes effect on the date on which the

 8-9     Texas Natural Resource Conservation Commission files a copy of the

8-10     dissolution and territory change order in the deed records of El

8-11     Paso County as required by Subsection (b) of Section 7 of this Act.

8-12           SECTION 13.  EMERGENCY.  The importance of this legislation

8-13     and the crowded condition of the calendars in both houses create an

8-14     emergency and an imperative public necessity that the

8-15     constitutional rule requiring bills to be read on three several

8-16     days in each house be suspended, and this rule is hereby suspended,

8-17     and that this Act take effect and be in force from and after its

8-18     passage, and it is so enacted.
